CHAPTER 610
(House Bill 1275)

AN ACT to repeal and re-enact, with amendments, Section 3-402(a)
of Article 66½ of the Annotated Code of Maryland (1970 Replace-
ment Volume), title "Vehicle Laws," subtitle "Subtitle 3. Certifi-
cates of Title and Registration of Vehicles," subheading "Part
IV. Registration of Vehicles," refining DEFINING the exemption
of certain trailers from registration in Maryland under certain
circumstances.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 3-402(a) of Article 66½ of the Annotated Code of
Maryland (1970 Replacement Volume), title "Vehicle Laws," sub-
title "Subtitle 3. Certificates of Title and Registration of Vehicles,"
subheading "Part IV. Registration of Vehicles," be and it is hereby
repealed and re-enacted, with amendments, to read as follows:

3-402.

(a)    Every motor vehicle, trailer, semitrailer, and pole trailer
when driven or moved upon a highway shall be registered under this
part except:

1.    Any such vehicle driven or moved upon a highway in conform-
ance with the provisions of this subtitle relating to manufacturers,
transporters, dealers, lienholders, or nonresidents or under a tem-
porary registration card issued by the Department;

2.    Any vehicle owned and used by the United States, unless
registration of such a vehicle is requested by a duly authorized
officer or employee of the United States;

3.    Any special mobile equipment as herein defined;

4.    Any vehicle whose front or rear wheels are lifted from the
highway, and any towed vehicle attached to a towing vehicle by a
tow bar and for which no driver is necessary; or

5.    Any trailer or semitrailer having a chassis weight not in
excess of 1000 pounds, duly registered in another state, but operated
in intrastate service within the State of Maryland, if the owner of
the trailer or semitrailer has registered annually in this State a
number of trailers or semitrailers equal to or in excess of the average
number of trailers or semitrailers the owner will have available
annually in this State for intrastate operations.

6.    Any vehicle owned by and in possession of a registered dealer
for purpose of sale.

(b)    Every person claiming exemption from registration under
paragraph 5 of subsection (a) shall file annually with the Department
at such time and in such manner as prescribed by the Department,
a statement under affidavit, which sets forth the total annual regis-
tration in all states, the total annual registration in this State, and
the average total number of such vehicles available for rent or lease
annually in this State, of all trailers and semitrailers intended or
designed to be pulled by Class "A" vehicles, and which are owned or
leased by such person.
