"Part 3. Crabs, Lobster and Terrapins," and to enact new Section
336 in lieu thereof, to stand in the place of the Sections repealed,
to provide for issuance of a license to take terrapin in certain
instances and for the adoption of regulations for the taking of
terrapin.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 336, 337, 338 and 340 of Article 66C of the Annotated
Code of Maryland (1970 Replacement Volume), title "Natural
Resources," subtitle "Fish and Fisheries," subheading "Part 3. Crabs,
Lobster and Terrapins," be and they are hereby repealed and that
new Section 336 be and it is hereby enacted in lieu thereof, to stand
in the place of the Sections repealed, all to read as follows:

[336. Closed season.

It shall be unlawful for any person to take or catch or have in
possession in this State any salt water terrapin, diamond back terra-
pin or skilpots and sliders, between the first day of April and the
thirty-first day of October in any year, both dates inclusive.

It shall be unlawful for any person to have in possession in this
State any terrapin mentioned in this section during any closed sea-
son, taken or caught within the State of Maryland or in any other
state, territory or country.

It shall be unlawful for any person to purchase and place in pen or
pens, or take from said pen or pens, any terrapin to be offered for sale,
barter or exchange during any closed season. Provided, however,
terrapin alive may be held in pens built in the water used by dealers
or persons for propagation purposes during the closed season.

337.    Size.

It shall be unlawful for any person to take or catch or have in
possession any terrapin mentioned in this subheading less than five
inches in length, measurement to be made on the bottom shell.

338.    Eggs.

It shall be unlawful for any person to interfere with or in any
manner take or destroy any terrapin eggs or have same in possession
at any time, provided, however, the possession of said eggs shall not
apply to persons owning pens built in the water, which are used for
propagation purposes during the closed season.

340. Traps, snares, etc.

Any terrapin mentioned in this subheading found in possession of
any person or any trap, snare, net or devices of any description,
which are being used for entrapping, except as. herein provided,
between the first day of April and the thirty-first day of October,
both dates inclusive, shall be conclusive evidence of a violation of this
subheading, and shall be confiscated by the Director of the Game
and Inland Fish Commission, any deputy game warden, constable or
police officer or any employee receiving compensation from the Com-
mission of Tidewater Fisheries, and disposed of by the Director of
the Game and Inland Fish Commission as he may deem advisable for
the best interest of the State.]
