"I. Crimes and Punishments," subheading "Health—Controlled
Dangerous Substances," to correct the error of including a portion
of the repealed law relating to confidential information assembled
by the Maryland Commission to Study Problems of Drug Addic-
tion in the present section relating to smelling or inhaling certain
harmful substances.
Whereas, Chapter 403 of the 1970 Laws of Maryland repealed
certain sections of Article 27 including Section 306D which related
to confidential information assembled by the Maryland Commission
to Study Problems of Drug Addiction, a commission which no longer
exists. Certain subsections of Section 306D were placed in new
Section 301 which relates to smelling or inhaling certain harmful
substances, a subject which has no relationship to the confidential
information; now, therefore,
Section 1. Be it enacted by the General Assembly of Maryland,
That subsections (b)(i), (b)(ii) and (c) of Section 301 of Article
27 of the Annotated Code of Maryland (1971 Replacement Volume),
title "Crimes and Punishments," subtitle "I. Crimes and Punish-
ments," subheading "Health—Controlled Dangerous Substances,"
be and they are hereby repealed:
301. (b)
[(i) It is unlawful for any person to give away or otherwise
to divulge to a person or persons not engaged in such research and
study for the Authority, any of such records, reports, statements,
notes, or other information which name or otherwise identify any
person or persons. Any person who violates any provision of this
subheading is guilty of a petty offense and upon conviction shall
be fined not more than fifty dollars ($50.00).
(ii) Access to and use of any such records, reports, statements,
notes, or other information also are protected and regulated by
the provisions of Section 101 of Article 35 and Section 10 of Article
75C of this Code, as amended from time to time.
(c) Nothing in this section applies to or restricts the use as
publicizing statistics, data or other material which summarize
or refer to any such records, reports, statements, notes or informa-
tion in the aggregate and without referring to or disclosing the
identity of any individual person or persons.]
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1971.
