charterer thereof, and the owner or operator of the terminal at
which the vessel discharges or receives bulk oil without being so
bonded, shall be punished by a fine of not more than five thousand
dollars ($5,000.00).

29BC.

The person responsible for the oil spillage shall be liable to any
other person for any damages to his real or personal property directly
caused by the spillage.

29B.

The Maryland Port Authority and the Department of Natural
Resources shall charge and collect a compensatory fee from the person
responsible for the oil spillage. This fee shall cover the cost of labor,
equipment operation, and materials necessary to eliminate the residue
of oil spillage and [shall be retained by the agency charging the fee.]
the cost of restoring areas damaged by the spillage to their original
condition and said fee shall be retained by the agency charging the
fee.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1971.

CHAPTER 505
(House Bill 129)

AN ACT to add new Section 2-316A to Article 95B of the Annotated
Code of Maryland (1964 Replacement Volume), title "Uniform
Commercial Code," subtitle "General Obligation and Construction
of Contract," subheading "Exclusion or modification of warran-
ties," to follow immediately after Section 2-316 thereof and to be
under the same subtitle, new subheading "Limitation of exclusion
or modification of warranties," to provide that language used by
the seller or manufacturer of consumer goods and services to
attempt to modify or exclude implied or express warranties shall
be unenforceable except in the case of express warranties by a
manufacturer who makes available facilities within the State to
provide performance of warranty obligations PROVIDES REA-
SONABLE AND EXPEDITIOUS MEANS OF PERFORMING
THE WARRANTY OBLIGATIONS.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 2-316A be and it is hereby added to Article 95B of
the Annotated Code of Maryland (1964 Replacement Volume), title
"Uniform Commercial Code," subtitle "General Obligation and
Construction of Contract," subheading "Exclusion or modification of
warranties," to follow immediately after Section 2-316 thereof and
to be under the same subtitle, new subheading "Limitation of ex-
