425) make Default whereby one or more Recovery or Recoveries Judgment or Judgments may be had and given for the said Edward Dorsey for Recovery of the said Land and Premisses against the said Timothy Murphey & for the said Timothy Murphey to recover over in value against the Common Vouchee according to the form of Common Recoveries in such Cases used And it is further Covenanted granted and agreed by and between the Parties to these presents and the true Intent and meaning of the Parties to these presents is that from and immediately after the said Common Recovery or Recoveries Shall be had and prosecuted as aforesaid of the said Land and Premisses the said Recovery or Recoveries shall be and enure and are hereby declared to have been intended to be and enure That the said Edward Dorsey and every other person that shall be seized of the premisses or any part thereof by virtue of the said Common Recovery or Recoveries Shall Stand and be seized thereof and of every part and parcel thereof with their and every of their appurtenances to the only use & behoof of the said Timothy Murphey his heirs and assigns and to no other use Intent or purpose Whatsoever In Witness whereof the parties to these presents have hereunto interchangeably set their Hands and Seals the Day and year first above written Sealed & Delivered E Dorsey seal in the presence of Basil Dorsey Jun.r 4 1/2 sides his John Hall Jun.r Timothy ┴ Murphey Recorded July 23.d 1759 mark Ex.d This Indenture made this twenty third Day of July in the year of our Lord one thousand seven hundred and fifty nine Between Thomas Warren of Charles County Planter of the one part and Notley Warren of the same County planter of the other part Whereas it was agreed between the said Thomas Warren and the said Notley Warren parties to these presents that in Consideration of the sum of five Shillings (Curr.t) |
