572) form as by Council Learned in the Law shall be Advised unto and upon which said Writ of Entry so to be Prosecuted and sued forth the said Robert Jenckins Henry shall appear Gratis in his own proper person or by his Attorney or Attorneys Lawfully Authorized and shall and will Vouch or call to Warrant the same Premisses the said Samuel Fountain wo shall appear Gratis in his own proper Person or by his Attorney or Attorneys Lawfully Authorized and shall and will Enter into the s.d Warranty and Vouch over to Warrant the same Premisses the Common Vouchee who shall thereupon appear and Enter into the said Warranty and after Imparlance make Default and Depart in Contempt of the Court so that Judgment may be thereupon had and Given for the said Ephraim Wilson to Recover the said Messuage or Tenement Lands Hereditaments & Premisses against the s.d Robert Jenckins Henry and for the said Robert Jenckins Henry to Recover in Value against the said Samuel Fountain and for the s.d Samuel Fountain to Recover in Value against the Common Vouchee to the End one Perfect Common Recovery with Double Voucher maybe thereupon had and suffered and all and every other thing and things to be done and Perfected Needfull and Convenient for the having and suffering the same Recovery according to the Course of Common Recoverys in such Cases used And the same Recovery is also to be Executed by one Writ of Habere facias Seisinam accordingly And it is hereby further Covenanted Concluded and Agreed by and Between all the said Partys to these Presents ^for themselves & every of them their & every of their Heirs that the said recovery so as af.d or in any other manner to be had & suffered of the said Messuage Tenements Lands & premisses above mentioned shall be & enure & shall be deemed adjudged & taken & is meant & intended & by all the said Parties to these Presents^ Declared to be and Enure to and for the only proper use and Behoof of the said Ephraim Wilson his Heirs and Assigns for Ever and the said Robert Jenckins Henry and his Heirs from and Immediately after suffering the same shall stand and be Seized of all and Singular the said Messuage Tenements Lands and Hereditaments above mentioned and every part and (Parcel) |
