diately after Section 27 thereof, and to be under the same title but
under the new subtitle "Enactment of Local Ordinances," all to read
as follows:
2. Expenses, director, deputy director, and attorney.
The members of said Commission except the Chairman shall not
receive any compensation for their services but shall be paid their
reasonably necessary expenses while engaged in the discharge of
their official duties.
The Governor shall appoint an Executive Director and a Deputy
Director, [who] each of whom shall be paid such compensation as
shall be provided in the budget, and who shall perform such duties
as may be prescribed by said Commission. In addition, in the absence
of the Executive Director, the Deputy Director shall perform all
functions and exercise all authority of the Executive Director. The
Chairman of the Commission shall be paid such compensation as
shall be provided in the budget.
The Commission is authorized to employ its own attorney, who
shall be appointed by the Governor, and who shall be paid such
compensation as shall be provided by law, and who shall act as
general counsel and legal advisor to the Commission and shall repre-
sent the Commission at all hearings and judicial [hearings] PRO-
CEEDINGS in which the Commission is a party.
11B.
No officer or employee of a State agency, department or board
shall discriminate in the hiring, firing or discriminate in any other
manner, against any person because of race, creed, color, sex, age
or national origin; provided, however, that no employment practice
not unlawful under Sections 17, 18, and 19 of this Article shall be
deemed as unlawful employment practice by the State.
If the Commission has received reliable information from any
individual or individuals, and after a proper investigation by the
Commission, it shall be determined by the Commission that an
officer or employee of a State agency, department or board has
engaged in discrimination in hiring, firing, or any other type of
activity against any person because of race, creed, color, sex, age
or national origin, and if the Commission is unsuccessful in resolving
the complaint, then the Commission shall report such act to the
Governor, and he shall review the case and findings of the Com-
mission. If the Governor is satisfied that an act of discrimination
has taken place, he shall remove or suspend said officer or employee
or take such action as he deems appropriate under the circumstances.
Provided, however, that any removal, suspension, or other action
affecting any officer or employee who is covered by the State Merit
System shall be subject to all rules and regulations pertaining1
thereto. The authority of the Commission relating to discrimination
in State agencies, boards or departments shall be limited to investi-
gation, conciliation, mediation and reporting to the Governor as
provided in this Section 11B.
12. Complaint to be filed with Commission.
(a) Any person claiming to be aggrieved by an alleged discrimi-
nation [as to any of the subtitles] prohibited by any section of this
Article [on the basis of race, creed, color, sex or national origin, and
