office on July 1, 1953, a person duly qualified to serve as Commis-
sioner for an initial term expiring on the first Monday in May, 1955,
or until his successor shall have qualified as hereinabove provided.
The Governor may at any time remove the Commissioner from office
for inefficiency, neglect of duty or malfeasance in office.] The Com-
missioner shall receive a salary as provided in the budget. The said
Commissioner shall be allowed [for] actual and necessary expenses
incurred in the discharge of his duties.
The [title of the present administrative assistant shall be] Divi-
sion shall have a deputy commissioner, who shall receive such salary
as may be set by the Standard Salary Board, or its successor, and
[the said deputy commissioner shall retain, without further exami-
nation,] who shall have all rights and privileges under the State
Merit System Law and the State Employees' Retirement System.
The deputy commissioner holding office on the effective date of this
Act shall continue to hold office subject to the provisions of Article
64A of this Code.
At any time hereafter the office of deputy commissioner shall
become vacant the State Commissioner of Personnel or his successor
shall, as soon as practical, conduct a competitive examination in
accordance with the State Merit System Law. The deputy commis-
sioner, in the event of the absence, death, resignation, disability, or
disqualification of the Commissioner, or in case of the office of the
Commissioner shall for any cause become vacant, shall have and
exercise all the powers and duties vested by law in the Commissioner.
[All other employees of the office of Commissioner of Labor and
Statistics shall be transferred to the Department of Labor and Indus-
try and retain their present classifications under the merit system
as obtained through examination and shall receive such salary scales
as set by the Standard Salary Board.]
The Commissioner is authorized and empowered to appoint or
employ such deputies, inspectors, assistants and employees of every
kind as may be necessary for the performance of the duties now or
hereafter imposed upon him by this or any other law; provided,
however, that such appointments and employments shall in each and
every case be subject to the approval of the Governor and the
Secretary of Licensing and Regulation and the compensation to be
allowed therefor, be subject to the approval of the Standard Salary
Board or its successor.
2.
It shall be the duty of the said Commissioner:
[1st] (1) To promote harmony between industry and labor.
[2nd] (2) To collect, systematize and report statistical details re-
lating to all matters within the jurisdiction of the [Department]
Division. Within the [Department of] Labor and Industry Division
there shall be a Division of Research and Information which on
behalf of and under the Commissioner of Labor and Industry shall
administer this duty. As early in the calendar year as is reasonably
possible the Commissioner shall prepare and deliver an annual report
to the Governor and the Secretary of Licensing and Regulation and
the members of the General Assembly, if requested, showing with
respect to the preceding calendar year, the various activities of the
[Department] Division.
