(c) The Governor, with the advice of the Secretary of Licensing
and Regulation, shall appoint as members of the Commission, no less
than two persons who are qualified by experience in at least some
phase of the home-improvement industry, and no less than one
person who is qualified by experience in the business of banking or
finance. Each member shall have been a citizen and resident of this
State for not less than five years preceding his appointment.
251.
(a) It is the duty of the Commission to administer and provide
for the enforcement of all the provisions of this subtitle. The Com-
mission has the powers expressly conferred or reasonably implied
from the provisions of this subtitle. The exercise or performance
of all powers, authority, duties and functions vested in the Com-
mission by the provisions of this subtitle, shall be subject to the
power and authority of the Secretary of Licensing and Regulation
as set forth in Article 41 of this Code, or elsewhere in the laws of
this State.
252.
(a) The Commission, subject to the approval of the Secretary of
Licensing and Regulation, shall employ an executive director who
shall be a full-time employee of the State. He shall hold office during
good behavior and shall be subject to removal with the approval of
the Secretary by the Commission or by a majority of the Com-
mission for incompetence or neglect of duty; but before the execu-
tive director may be removed from office he shall be given a copy
of the charges against him and an opportunity of being publicly
heard in person or by counsel in his own defense upon not less than
ten days' notice.
The executive director shall:
(1) Take charge of the office of the Commission;
(2) Have custody of the official records and the seal; and
(3) Collect, account for, and pay over all fees required by this
subtitle in such manner as may be determined by rule or regulation
of the Comptroller of the State of Maryland. The executive director
shall, upon entering the performance of his duties, be covered by a
surety bond in accordance with the provisions of Sections 46 through
50 of Article 78A of the Annotated Code of Maryland.
(c) Such other assistants and clerks as may be necessary to assist
in discharging the duties imposed by this subtitle, shall be appointed,
subject to the approval of the Secretary of Licensing and Regula-
tion, by the executive director.
(d) The Commission may, subject to the approval of the Secre-
tary of Licensing and Regulation, employ and discharge at any time
inspectors or auditors. It also may employ investigators whose posi-
tions shall be within the merit system established by Article 64A
of this Code. The Attorney General of Maryland may appoint a
qualified attorney at law who shall serve at the pleasure of the At-
torney General to represent the Commission.
