and "Montgomery County," subtitle "Park and Planning Commis-
sion," be and the same is hereby repealed and re-enacted to read
as follows:

59-73 (70-79)

The Commission has authority to establish grades for all roads
within the Regional District, provided, however, in Montgomery
County all road grades so established shall be established within
the tolerances set forth in the provisions of the Montgomery County
Road Code [.]; and further provided that in the 'portion of the
Regional District within Prince George's County the Commission
shall delegate its authority to establish road grades to the Depart-
ment of Public Works of that County.
Until a grade has been
established by the Commission, no grading of a permanent nature
shall be made. Any unauthorized grading of a permanent nature
by any state, municipal or county officer or employee or by any pri-
vate person is declared to be a misdemeanor and punishable as such
under the provisions of this subtitle.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1970.

CHAPTER 362
(House Bill 905)

AN ACT to add new Section 9(11K) to Article 81 of the An-
notated Code of Maryland (1969 Replacement Volume), title
"Revenue and Taxes," subtitle "What Shall Be Taxed and Where,"
to follow immediately after Section 11J thereof, to exempt farm
machinery, farm implements, and livestock in St. Mary's County
from the personal property tax.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 9(11K) be and it is hereby added to Article
81 of the Annotated Code of Maryland (1969 Replacement Volume),
title "Revenue and Taxes," subtitle "What Shall Be Taxed and
Where," to follow immediately after Section 11J thereof, and to
read as follows:

9.

(11K) For the purposes of county taxation in St. Mary's County,
the farm machinery, farm implements and livestock of any bona fide
farmer shall be entirely exempt.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1970.
