CHAPTER 355
(House Bill 780)

AN ACT relating to the Washington Suburban Sanitary District,
to add Sections 83-71(k) and 71-19 (k) to the Public Local Laws
of Prince George's County (1963 Edition) and to the Montgomery
County Code (1965 Edition), respectively, and to repeal and re-
enact, with amendments, Sections 83-80A and 71-28A of said
Codes, respectively, being Articles 17 and 16, respectively, of the
Code of Public Local Laws of Maryland, titles "Prince George's
County" and "Montgomery County," subtitle "Washington Sub-
urban Sanitary District," relating to procedures and charges for
water and sanitary sewer connections made by the Washington
Suburban Sanitary Commission, authorizing the Commission to
establish procedures under which applicants for such connections
may pay the whole or a portion of the connection fees on a de-
ferred or installment basis, providing that the installation of such
connection is a benefit to the property so connected and the benefit
charge assessed therefor shall be collected in annual installments,
payable and collectible as are benefit charges for water and sewer
lateral lines, including the provisions for collection by the Treas-
urers of Prince George's and Montgomery Counties, respectively,
providing for payment of the unamortized balance by any govern-
mental agency acquiring property against which there is outstand-
ing the lien for the unpaid portion of the water or sewer connec-
tion benefit charge, and authorizing the Commission to obtain
capital funds for the connection charges to be paid on a deferred
basis by including such purpose and using the proceeds from the
issuance and sale of bonds for the general construction of water
and sewer lines.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 83-71 (k) and 71-19(k) are hereby added, respectively,
to the Public Local Laws of Prince George's County (1963 Edition)
and the Montgomery County Code (1965 Edition), being Articles 17
and 16, respectively, of the Code of Public Local Laws of Maryland,
titles "Prince George's County" and "Montgomery County," subtitle
"Washington Suburban Sanitary District," and Sections 83-80A
and 71-28A of the said Codes be and they are hereby repealed and
re-enacted, with amendments, and all to read as follows:

83-71. (71-19).

(k) When, under the provisions of 83-80A (71-28A) the charge
or a portion of the charge for a water or sanitary sewer connection
is made payable on a deferred or installment basis, the installation
of such connection shall be a benefit to the property, or that part of
the property determined by the Commission to be served by the con-
nection, and the deferred portion of the connection charge, together
with interest, shall be paid by an annual benefit charge in an amount
and for a period of years necessary to amortize the account. The
water and sewer connection benefit charges established and levied by
the Commission under this subsection shall be in addition to any
benefit charge established or levied under any other subsection
hereof. The Commission shall make provision for the owner of a
property subject to a benefit charge for the deferred portion of a con-
