Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1970.

CHAPTER 351
(House Bill 617)

AN ACT to repeal and re-enact, with amendments, Section 16(a)
of Article 1A of the Annotated Code of Maryland (1968 Replace-
ment Volume), title "Aeronautics," subtitle "Airport Zoning,"
revising the definition of airports subject to zoning regulation by
political subdivisions.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 16 (a) of Article 1A of the Annotated Code of Maryland
(1968 Replacement Volume), title "Aeronautics," subtitle "Airport
Zoning," be and it is hereby repealed and re-enacted, with amend-
ments, to read as follows:

16.

(a) Definitions.—As used in this section, unless the context
otherwise requires:

(1) ["Airport" means any area of land or water, or both, owned,
controlled or operated by any political subdivision, or subdivisions,
designed and set aside for the landing and taking off of aircraft
and used or to be used in the interest of, or by, the public for such
purposes;] "Airport" means any area of land or water, or both,

which is used, or intended for use, by the public for the landing

and take off of fixed wing aircraft, and any appurtenant areas which

are used, or intended for use for airport buildings or other airport

facilities or rights of way, together with all airport buildings and
facilities located thereon AIRPORT, AS DEFINED IN SUBSEC-
TION 1(C) OF THIS ARTICLE, WHICH IS LICENSED BY THE
MARYLAND AVIATION COMMISSION;

(2)    "Airport hazard" means any structure, tree or use of land
which interferes with communication between an airport and air-
craft approaching or leaving the same or which obstructs the
aerial approaches of an airport or which is otherwise hazardous
to its use for landing or taking off of aircraft;

(3)    "Aircraft" means any contrivance now known, or hereafter
invented, used or designed for navigation of or flight in the air;

(4)    "Political subdivision" means any county or any incorpo-
rated municipality;

(5)    "Person" means any individual, firm, copartnership, corpora-
tion, company, association, joint stock association or body politic,
and includes any trustee, receiver, committee, assignee or other
similar representative thereof;
