subtitle "General Regulations," be and it is hereby repealed and
re-enacted, with amendments, to read as follows:

108B.

Dual directorships are prohibited in [like] banking institutions
unless the Commissioner finds that such dual directorship is in the
public interest and not detrimental to either or both of the two in-
stitutions. Any person now serving a dual directorship shall not
be prohibited from completing his term or from being re-elected to
such dual directorship. This section shall not apply to any building
or savings and loan association.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1970.

CHAPTER 341
(House Bill 414)

AN ACT to repeal and re-enact, with amendments, Section 366 of
Article 27 of the Annotated Code of Maryland (1967 Replacement
Volume), title "Crimes and Punishments," subtitle "I. CRIMES
AND PUNISHMENTS," SUBHEADING "Lotteries," to change
the penalty for second offenders of the sections of this article re-
lating to lotteries.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 366 of Article 27 of the Annotated Code of Maryland
(1967 Replacement Volume), title "Crimes and Punishments," sub-
title "I. CRIMES AND PUNISHMENTS," SUBHEADING "Lotter-
ies," be and it is hereby repealed and re-enacted, with amendments,
to read as follows:

366.

If any person shall be a second time convicted of any of the of-
fenses mentioned in any of the sections of this article relating to
lotteries, he shall [on conviction be confined in the penitentiary not
less than two nor more than five years; and any] upon conviction

be fined a sum not less than two thousand dollars nor more than five

thousand dollars; or in the discretion of the court shall be im-

prisoned for a period not less than two nor more than five years;

or shall be both fined and imprisoned, UPON CONVICTION, BE
FINED NOT MORE THAN FIVE THOUSAND DOLLARS OR
SHALL BE IMPRISONED FOR NOT MORE THAN FIVE YEARS,
OR BOTH. Any recovery of a penalty for violating any of the pro-
visions of this article relating to lotteries, whether by indictment or
action of debt, or before a justice of the peace, shall be regarded as
a first conviction under this section.

Sec. 2. And be it further enacted, That this Act shall take effect
on July 1, 1970.
