(d) "Public body" means the State or any department, officer,
board, commission, or agency of the State [, but this term shall not
mean any State agency funded primarily from sources other than
the State, nor shall it mean any county or municipal corporation,
or any department, officer, board, commission, or agency thereof].

(b) If any such workman or apprentice is paid less than the
compensation to which he is entitled hereunder, the contractor shall
make restitution to the affected employee for the amount due and
shall be liable to the contracting public body for liquidated damages
at the rate of ten dollars ($10.00) per day for each employee so
underpaid. Each day's violation constitutes a separate offense.
(d) Where a laborer performs the work ordinarily performed by
any skilled mechanic or his apprentice, he shall be paid for the
entire time he has performed such work at the rate of wages appli-
cable to a skilled mechanic; and in the event of such underpayment,
restitution shall be made by the contractor to said employee, and in
addition, the contractor shall be liable to the contracting public body
for liquidated damages in an amount equal to ten dollars ($10.00)
per day for each such violation. Each violation each day constitutes
a separate offense.
(e) On any public works to which this subtitle applies, only com-
petent workmen and apprentices of the trades, crafts, and occupa-
tions shall be employed by the contractor and all subcontractors on
the public works, provided that for every five mechanics regularly
employed by the contractor there may be employed not more than
one apprentice; provided, however, that if less than five such
mechanics are employed, there may be employed not more than one
apprentice. THE USE OF APPRENTICES, FOR EACH CRAFT
INVOLVED, SHALL CONFORM TO THE APPRENTICESHIP
PROGRAMS APPROVED BY THE BUREAU OF APPRENTICE-
SHIP TRAINING OF THE U. S. DEPARTMENT OF LABOR,
AND AS REGISTERED WITH THE MARYLAND APPREN-
TICESHIP COUNCIL, DEPARTMENT OF LABOR AND IN-
DUSTRY.
99.
(a) Any prospective bidder or his representative, any represen-
tative of any group of employers engaged in the particular type of
construction involved, any representative of any classification of
workmen, or the public body, within ten (10) days after the call for
bids on the public work involved, may file with the Commissioner a
verified petition, which sets forth the facts upon which it is based,
to review the determination of any prevailing wage rate or rates.
(e) The governing body of every political subdivision of this
state may provide by resolution that the political subdivision shall
be covered by this subtitle and included within the scope of its pro-
visions and any such political subdivision shall constitute a "public
State is notified in writing by the governing body that such action
has been taken.
