CHAPTER 293
(Senate Bill 570)

AN ACT to repeal and re-enact, with amendments, Sections 96 (b),
96(c), 96 (d), 97 (b), 97 (d), 99, 100 (c), 101 (b), 101 (d)
and 105 of Article 100 of the Annotated Code of Maryland (1969
Supplement,) title "Work, Labor and Employment", subtitle
"Contracts for Public Works," and to add new Sections 97 (e),
98(e), 100 (d), 100 (e) and 104 (c) to said title and subtitle of
said Article and Code, to follow, respectively, immediately after
Sections 97 (d), 98(d), 100 (c) and 104 (b) thereof, to broaden
the definition of "construction"; to broaden the law's application
to all contracts without regard to dollar amount; to provide for

the voluntary inclusion of political subdivisions of the State; to
provide for the payment of liquidated damages and the with-
holding of payments to contractors in violation of certain provi-
sions of the law; to provide for a ratio of employment between
mechanics and their apprentices;
THE KINDS OF EMPLOYEES
USED ON PUBLIC WORKS CONTRACTS UNDER THIS ACT
AND THE USE OF APPRENTICES; to provide for the review
of wage rate determinations upon proper petition; to provide for
the maintenance and submission of payroll records; to prohibit
the awarding of contracts for a three ONE-year period to contrac-
tors and subcontractors found in violation of the law; to provide
procedures for enforcing compliance with the law by public bodies;
and relating generally to the conditions of employment, require-
ments of employers and the powers and duties of certain public
officials under certain contracts and subcontracts for public works
in this State.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 96 (b), 96(c), 96 (d), 97 (b), 97 (d), 99, 100 (c),
101 (b), 101 (d) and 105 of Article 100 of the Annotated Code of
Maryland (1969 Supplement), title "Work, Labor and Employment,"
subtitle "Contracts for Public Works," be and they are hereby re-
pealed and re-enacted, with amendments; and that new Sections 97
(e), 98 (e), 100 (d), 100 (e) and 104 (c) be and they are hereby
added to said title and subtitle of said Article and Code, to follow,
respectively, immediately after Sections 97 (d), 98 (d), 100 (c), and
104 (b) thereof; all to read as follows:

96.

(b) "Construction" includes all construction, reconstruction, im-
provement, enlargement, [and] painting and decorating, alteration,
maintenance or repair.

(c) "Public works" includes all buildings, bridges, roads, streets,
alleys, ditches, sewage disposal plants, water works, and all other
structures or works, constructed for public use or benefit or paid

for wholly or in part out of public funds, except work done by any

public utility company pursuant to order of the Public Service Com-
mission or other public authority, whether or not done under public
supervision or direction or paid for wholly or in part out of public
funds, unless let to contract [provided, however, that for the purposes
of this subtitle contracts of less than $500,000 shall be excluded].
