CHAPTER 266

(Senate Bill 200)

AN ACT to repeal and re-enact, with amendments, Sections 6-306(b)
and 9-109(c) of Article 93 of the Annotated Code of Maryland
(1969 Supplement), title "Decedents' Estates," subtitles "The Per-
sonal Representative" and "Special Provisions Relating to Distri-
bution," amending the decedents' estates law of this State in order
to make certain corrections in the references thereof.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 6-306(b) and 9-109(c) of Article 93 of the Annotated
Code of Maryland (1969 Supplement), title "Decedents' Estates,"
subtitles "The Personal Representative" and "Special Provisions Re-
lating to Distribution," be and the same are hereby repealed and
re-enacted, with amendments, to read as follows:

6-306.

(b)  A hearing shall be conducted by the court prior to the re-
moval of any personal representative. Such hearing may be held on
the court's own motion, on motion of the register, or on written
petition of any interested person. Notice of such hearing shall be
given by the register to all interested persons. After such notice has
been given to the personal representative, he may exercise only the
powers of a special administrator as permitted by Section [6-402]
6-403.

9-109.

(c)  In addition to the procedures in subsections (a) and (b),
whenever a personal representative is required to distribute any
property included within the definition of "custodial property" [as
defined in [Article 16, Section 213(e)] Article 93A, Section 301 (e)]
the personal representative, with the approval of the court, may
transfer such property to a custodian who shall hold or dispose of
the property in accordance with the provisions of the Maryland
Uniform Gifts to Minors Act. The personal representative shall,
subject to the approval of the court, designate the custodian, who
shall be an adult, a guardian of the minor, or a trust company as
defined in [Article 16, Section 213 (a), (h) and (p)] Article 93A,
Section 301 (a), (h) and (p).

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1970.
