(2)    "Nursing Home Administrator" means a person who ad-
ministers, manages, supervises, or is in general administrative
charge of a nursing home, whether or not he has an ownership
interest in the home, and whether or not his functions and duties
are shared with one or more individuals.

(3)    "Nursing Home" has the same meaning as that term is
defined in Section 556(e)(1) of this Article (1965 Replacement
Volume, as amended), as more fully set forth in the rules and
regulations of the Department of Health and Mental Hygiene con-
sistent with this Article.

(4) "Person" means any company, corporation, association, or
individual.

756.    Administrator License Required.

Ninety days after the effective date of this subtitle, no nursing
home in the State may operate as such unless it is under the super-
vision of an administrator who holds a currently valid nursing home
administrator's license and registration, or temporary license, issued
pursuant to this subtitle. No person shall practice or offer to prac-
tice nursing home administration in this State or use any title, sign,
card or device to indicate that he is a nursing home administrator,
unless he is duly licensed and registered as a nursing home ad-
ministrator or licensed as a temporary nursing home administrator
as required by this subtitle.

757.    Board of Examiners of Nursing Home Administrators.

(a) Creation of Board. There is hereby created the Maryland
State Board of Examiners of Nursing Home Administrators, which
shall consist of nine (9) members. The Board shall be part of the
Department of Health and Mental Hygiene and make reports directly
to the Secretary of that Department at the times he prescribes.
The Board shall be appointed by the Governor, upon the recom-
mendation of the Secretary of Health and Mental Hygiene from a
list of nominees selected by the Secretary after consultation with
the associations and societies appropriate to the disciplines and pro-
fessions representative of the vacancies to be filled, and it shall
consist of the following members:

(1)    Four (4) members actively engaged in the management and
operation of either a proprietary or non-profit nursing home or
homes as Administrator with five years' experience in such operation,
who are licensed, or in the case of initial appointments are eligible
for licensure under this subtitle;

(2)    Four (4) members, other than nursing home administrators,
who are actively engaged in professions concerned with the care
of the chronically ill or of infirm or aged patients; and

(3)    One (1) member from the general public who is not engaged
in the management, ownership, operation, or supervision of any
nursing home or hospital.

No more than two members of the Board shall be officials or full
time employees of State or local governments. All members of the
Board shall be citizens of the United States or have declared their
