Sec. 3. And be it further enacted, That all laws or parts of
laws, public general or public local, inconsistent with the provisions
of this Act are repealed to the extent of the inconsistency.

SEC. 4. And be it further enacted, That this Act shall take effect
July 1, 1970.

CHAPTER 249
(Senate Bill 542)

AN ACT to repeal and re-enact, with amendments, Section 387B
(a) (1) of Article 43 of the Annotated Code of Maryland (1957
Edition, 1965 Replacement Volume), title "Health," subtitle
"Water, Ice and Sewerage," to provide for the financing from
the Sanitary Facilities Fund of planning for solid waste disposal
systems and solid waste acceptance facilities and to permit the
planning for solid waste disposal systems and solid waste ac-
ceptance facilities to be financed jointly by or under the joint
authority of the State Department of Health and any county or
Baltimore City.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 387B (a) (1) of Article 43 of the Annotated Code
of Maryland (1957 Edition, 1965 Replacement Volume), title
"Health," subtitle "Water, Ice and Sewerage," be and it is hereby
repealed and re-enacted, with amendments, to read as follows:

387B.

(a) A Sanitary Facilities Fund is hereby established. It shall
consist of two parts, as follows:

(1) The planning part which shall be available to the State
Department of Health to finance planning for sewerage facilities
and for solid waste disposal systems and solid waste acceptance
facilities.
The State Department of Health is hereby authorized to
utilize funds appropriated in the program of the annual State
operating budget which provides for general local health services,
for this purpose. When so used, the proportion of State, county,
and local funds, respectively, shall be that specified for the financing
of minimum health services. The planning for sewerage facilities,
for solid waste disposal systems, and for solid waste acceptance
facilities
to be financed in this manner may be financed jointly by,
or under the joint authority of the State Department of Health
and any county or Baltimore City.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1970.
