2678                               Municipal Charters

106-49. Same—Notice and hearing.

Before revoking or suspending any passenger vehicle license, except
as otherwise provided in this chapter, the director of the department of
inspection and licenses shall notify the holder of the reasons for the
proposed action and set a day and time for a hearing thereon, at which
time the holder shall be granted an opportunity to show cause why such
license should not be suspended or revoked. The hearing shall be held
before a board of review, whose members shall be the director, a repre-
sentative of officer rank of the county police designated by the county
superintendent of police, and an attorney from the county attorney's
office. At the conclusion of the hearing, the board members shall give their
recommendations to the director, and the director shall take such action
as he determines is necessary to fulfill his responsibilities under this
chapter. Failure of the holder of a passenger vehicle license to appear
at the time and place set for the hearing, after notice, shall be deemed a
waiver of the right to a hearing.

A certified letter from the director or department to the last address
on file with the department for the person against whom action has been
or is to be taken shall be sufficient notification for the purposes of any
action taken by the director under the provisions of this section. Personal
service on the license by the director or other authorized agent shall also
be deemed sufficient notice.

Section 20. Section 109-3, Chapter 109, title "Weapons" of the
Montgomery County Code 1965, as amended, is hereby repealed and re-
enacted, with amendments, to read as follows:

109-3. Range approval committee established; powers, duties and
functions.

There is hereby established a range approval committee for Mont-
gomery County to be composed of seven members who shall be appointed
and removed and whose compensation shall be fixed by the County Execu-
tive with the approval of the Council. Members of the range approval
committee shall serve for a term of three (3) years. The county executive
shall designate one member of the range approval committee to serve as
chairman. One ex officio member shall be an employee of the division of
police protection. The committee shall issue target, trap and skeet range
and shooting area approval certificates, which certificates may specify the
type of gun or ammunition which may be used on such range or area.
Any such approval certificate shall be valid for eighteen months after its
issuance, and shall be issued only upon a finding by a majority of the
committee that the discharge of guns upon such ranges or area will not
jeopardize life or property. No range or area shooting certificate shall
be issued except upon the written application of the owner, lessee or person
lawfully in possession of the land upon which is located the range or area
sought to be licensed or approved. All certificates shall be retained by the
range approval committee as part of its permanent records.

Section 21. Section 113-2, Chapter 113, title "Elm Disease" of the
Montgomery County Code 1965, is hereby repealed and re-enacted, with
amendments, to read as follows:

113-2. Administration and enforcement of chapter.

The county forester is hereby charged with the responsibility for
administration and enforcement of this chapter.
