18-2. Superintendent under supervision of county executive.

The superintendent of the county police shall at all times be under
the supervision and order of the county executive.

Section 28. Section 2-81A, Chapter 2, title "Administration" of the
Montgomery County Code 1965, as amended, is hereby repealed and re-
enacted, with amendments, to read as follows:

2-81A. Generally.

There is hereby established a department of community development
under the immediate direction of a director of community development
who shall be appointed by the county executive with the approval of the
county council. The department of community development shall, subject
to the public general and local laws, have such functions as may be author-
ized from time to time by the county executive or as the county council
may prescribe by law.

Section 29. Severability. The provisions of this Article are severable
and if any provision, sentence, clause, section or part thereof is held illegal,
invalid or unconstitutional or inapplicable to any person or circumstances
such illegality, invalidity or unconstitutionality, or inapplicability shall not
affect or impair any of the remaining provisions, sentences, clauses, sec-
tions or parts of the Article or their application to other persons or circum-
stances. It is hereby declared to be the legislative intent that this Article
would have been adopted if such illegal, invalid or unconstitutional provi-
sion, sentence, clause, section or part had not been included therein, and if
the person or circumstances to which the Article or any part thereof is
inapplicable had been specifically exempted therefrom.

Section 30. Effective date. This Act shall take effect December 7,
1970.
