2670                               Municipal Charters

Director; Staff; Volunteers; Operations.

(a) The county executive shall appoint, subject to the confirmation
of the county council, the director of the office of public defender upon the
recommendation of the board of trustees. The director shall appoint the
personnel of said office after recommendation of the board of trustees.
The director shall be responsible for the supervision of the legal work
and administration of said office and perform such duties as the board of
trustees may prescribe. The director shall be a member of the bar of, and
qualified to practice law in, the State of Maryland. The board and the
county executive may delegate to the director such powers of the board
and office as the said board and county executive may find to be in the
interest of good administration.

Section 25. Section 2-181, Chapter 2, title "Administration" of the
Montgomery County Code 1965, as amended, is hereby repealed and re-
enacted, with amendments, to read as follows:

2-181. Report to County Executive.

The board of trustees of the office shall, on or before November 1 of
each year, submit a report of the office to the county executive. Said report
shall include any information required by the county executive together
with all pertinent data on the operation of the office including projected
needs, a breakdown of the number and type of cases handled and relative
dispositions, recommendations for statutory changes at the County and
State level including changes in the criminal law or court rule as may be
appropriate to the improvement of the system of criminal justice, control
of crime and rehabilitation of offenders. Said board shall also forward a
copy of the report required by this section to each member of the panel
described in section 2-179. Such panel shall meet with the board of trustees
and director not later than September 1 of each year to review the work
and financial needs of the office in light of the report submitted the
previous fiscal year, as required by this section.

Section 26. Section 13-3, Chapter 13, title "Jail and Prisoners' of
the Montgomery County Code 1965 is hereby repealed and re-enacted,
with amendments, to read as follows:

13-3. Same—Same—Supervision; type to be performed.

The work provided for in section 13-1 of this Code shall be assigned
in the discretion of the warden but shall be performed under the direction
of the county executive or any road supervisor or other official who may be
authorized by the county executive to work prisoners or any authorized
member of the state police where the work is to be performed on state
roads or property as provided in such section, and the warden of the jail,
upon the request of the county executive or other persons duly authorized
by him to make such request, is hereby authorized to deliver such prisoner
to the party designated. The work to be performed by such prisoner may
include every service necessary for the purpose of draining, grading,
paving, repairing or maintaining such public streets or other public prop-
erty or protecting life and property during a community disaster or emer-
gency, and for the purpose of cleaning and maintaining the county jail
and preparing and serving food to the prisoners therein.

Section 27. Section 18-2, Chapter 18, title "Police" of the Montgomery
County Code 1965 is hereby repealed and re-enacted, with amendments,
to read as follows:
