Montgomery County                                 2649

Be It Enacted by the County Council for Montgomery County, Maryland,
that—

Section 1. Chapter 88, Montgomery County Code 1965, is amended
to add a new Section 88-11, title "Board of Community and Mental Health",
to read as follows:

Sec. 88-11. There is hereby established a Board of Community and
Mental Health composed of nine (9) members appointed by the County
Council who shall be selected for their demonstrated interest, competence,
and/or concern in matters related to community and mental health. At
least three (3) members shall not be health professionals. Prior to its
making appointments, the Council shall request the Montgomery County
Medical Society, Montgomery County Mental Health Association, the
Southern Maryland Dental Society, the Washington Society of Clinical
Psychologists, the Maryland Psychological Association, the Suburban Mary-
land Chapter of the Washington Psychiatric Society, and other appropriate
organizations to submit their recommendations within thirty (30) days as
to those persons qualified for such appointment. The recommendations shall
not be binding on the Council.

The County Health Officer shall serve as a non-voting, ex officio
member.

Members shall be residents of Montgomery County and shall be
appointed for three-year terms. Original members shall be appointed for
one, two, and three-year terms as the Council shall determine to achieve
staggered terms.

The Council may designate a member of the Board to be its chairman.
In the absence of any member being so designated, the Board shall elect
a chairman. The Board may elect such other officers as it may deem
necessary. The Board shall meet not less than four (4) times a year.
A meeting of the Board may be called by the chairman on his own
initiative or on petition of three or more members. The Executive* is
authorized to make available such staff services, information, and facilities
to the Board as necessary to perform its duties hereunder. Members of
the Board shall serve without compensation unless the Council shall by
resolution, from time to time, fix compensation for the members. The
Board shall submit a written annual report to the Executive and Council
no later than January 31 of each year.

The duties of this Board shall include:

(a)    Advise the Health Officer and the Council** on the feasibility,
planning, adequacy and on construction plans of public and private health
and mental health facilities which require County government approval
and/or funds.

(b)    Recommend public health and mental health goals to the
Council** and the Health Officer.

(c)    Advise the Health Officer and the Council** on alternative pro-
grams to attain public health and mental health goals and advise on pro-
gram emphasis and priorities.

(d)    Recommend to the County Health Officer and to the Executive
and Council items the Board believes should be included, deleted, reduced,
or increased in the budget of the Department of Health.
