full faith and credit for the construction of a fire engine house within
the Bethesda District as the boundaries are defined by Chapter 28,
Montgomery County Code 1965, as amended, prescribing the terms
and conditions, by reference, upon which said bonds shall be issued
and delivered and other incidental details with respect thereto; pro-
viding for the levy of unlimited ad valorem taxes for the pay-
ment of the principal and interest thereof, and providing that
the principal and interest may be paid primarily from proceeds of
the district tax levied under the provisions of the said Chapter 28,
with such other terms and conditions as the County Council may
determine by resolution.
Be It Enacted by the County Council for Montgomery County, Mary-
land, that—
Section 1. Montgomery County, Maryland, is hereby authorized at
any time, and from time to time, upon its full faith and credit to borrow
money and incur indebtedness in a total amount not exceeding $850,000
for financing the construction of a fire engine house within the boundaries
of the Bethesda District as defined by Chapter 28, Montgomery County
Code 1965, as amended, for the use of the Bethesda Fire Department,
Inc., or its successor including the development of the site therefor,
the architectural and engineering services incident thereto and the ac-
quisition and installation of necessary permanent furnishings, fixed per-
manent equipment and fire fighting equipment therefor. The proceeds from
said bonds may be applied to the payment of the first six months' interest
on said bonds.
Section 2. Sections 2-111 through 2-119, inclusive, of the Montgomery
County Code 1965, as amended, and each and every part of such sections,
excepting therefrom only subsections (a), (b) and (d) of Section 2-111,
be and they are hereby incorporated in this Act, by reference, as a
part hereof, it being the intention of the County Council that said sections
shall be applicable in all respects to the borrowing of money, the issuance
of bonds, the application of the proceeds of such bonds, and the levy
of unlimited ad valorem taxes for the payment of the principal and
interest of the bonds authorized by this Act.
Section 3. The powers granted by this Act are additional and cum-
ulative and the bonds authorized by this Act may be issued notwith-
standing that other bond acts or laws may provide for the issuance
of other bonds or the borrowing of money for the same or similar purposes
on the same or other terms and conditions.
Section 4. Before borrowing any money or issuing any bonds pur-
suant to this authority, the County Council shall adopt, in addition to
or as a part of any other resolutions required by Sections 2-111 through
2-119 of the Montgomery County Code 1965, as amended, a resolution
prescribing the terms and conditions on which the proceeds of the bonds
authorized hereunder shall be made available for use by the Bethesda
Fire Department, Inc., or its successor. The Council may provide by such
resolution that, in addition to the fact that the bonds authorized here-
under are an irrevocable pledge of the full faith and credit of the entire
County, the principal and interest on such bonds shall be paid primarily
from the taxes levied within the Bethesda District pursuant to Chapter
28, Montgomery County Code 1965, as amended.
Section 5. This Act shall take effect on the 76th day following its
enactment.
