or render such waters harmful, detrimental, or injurious to public health,
safety or welfare, or to domestic, commercial, industrial, agricultural,
recreational, or other legitimate beneficial uses, or to livestock, wild
animals, birds, fish or other aquatic life.

4.  "Marina." A modern boat basin, restricted to recreational marine
craft of all types, with facilities for one or more of the following: berthing,
launching, and securing such craft, and permitting incidental minimum
provision for refueling and emergency servicing, and also land (out-of-
water) storage.

5.   "Owner" shall mean a person or persons, partnership, firm, or
corporative enterprise undertaking or participating in the operation of
a marina.

6.   "Approving Authority" shall be the health officer of Baltimore
County or any duly authorized representative.

b.  Responsibilities of Marina Owners

All owners of marinas or areas where boats are berthed shall pro-
vide adequate toilet facilities and potable water supply. Location of such
facilities shall be approved by the Baltimore County Department of Health.
Garbage containers are to be provided in conformance with the Baltimore
County Code, Section 13-29.

c.  Toilet Facilities at Marinas.

Toilet facilities will be required at a marina in accordance with
the following standards:

1.  Minimum of one toilet and one lavatory for each sex.

2.   Additional facilities, above the minimum, shall be provided at the
rate of one toilet and one lavatory for each sex for every additional
one hundred boat docking slips and/or permanent mooring buoys, or frac-
tion thereof.

3.   Such facilities shall be located ashore within 100 feet from the
shore end of any dock if public sewer is available. If underground disposal
is used, facilities shall be located as close as soil conditions permit. When
the marina contains more than one pier, the facilities shall be centrally
located. In cases where satisfactory location is not available, these terms
may be modified at the discretion of the Health Officer of Baltimore
County.

4.   All sanitary facilities must be connected in an approved manner
to water supply and sewage disposal systems in accordance with reg-
ulations of the Maryland State Department of Health.

d.  Non-useable Facilities.

Toilet facilities on boats docked at marinas shall not be used. It
is the responsibility of the owner to post a notice to this effect in a
conspicuous place.

e.  Inspections.

The provisions herein shall not authorize entry by force to make
any inspection and in the event the owner, tenant, or one in possession
of any marine vessel, or a person in charge thereof, shall refuse to
permit entry for such an inspection, entry for such purpose shall be
allowed only through the properly issued warrant in accordance with law.
