THEREOF except upon a valid prescription of a physician, dentist or veter-
inarian. Exempt from this prohibition are sales made to registered prac-
titioners of pharmacy, medicine, dentistry, or veterinary medicine, or sales
made by any manufacturer, wholesale druggist, or licensed pharmacist to a
hospital or institution operating a dispensary in which a practitioner
licensed by law to administer dangerous drugs is in charge.

(c)   It shall be unlawful for any person to possess or have under
his control, except where such is in the regular course of business,
occupation, profession, employment or duty of such person, any preparation
containing opium OR ANY DERIVATIVES THEREOF, unless such person
obtained such drug on prescription of a physician, dentist or veterinarian.

(d)   Penalties. Any person who violates the provisions of this section
shall be guilty of a misdemeanor and upon conviction thereof, shall be
fined not less than two hundred fifty dollars ($250.00) nor more than one
thousand dollars ($1,000.00) for the first offense; and if convicted a
second time for a violation of this section, the person or persons so
offending shall be fined a sum not less than five hundred dollars ($500.00)
nor more than two thousand dollars ($2,000.00); and in case of being
convicted more than twice for a violation of this section, such person
or persons shall be imprisoned for not less than six nor more than eighteen
months.

Section 2. And be it further enacted, That this act shall take
effect forty-five days after its enactment.

Bill No. 123

An Act, to provide for the regulation of pollution from boats at
marinas in Baltimore County, by adding section 13-36 to the Bal-
timore County Code, 1968, title "Health and Sanitation," article
"Garbage, Trash, Ashes and Other Offensive Matters."

Section 1. Be it enacted by the County Council of Baltimore County
Maryland,
That section 13-36 be and it is hereby added to the Baltimore
County Code, 1968, title "Health and Sanitation," article "Garbage, Trash,
Ashes and Other Offensive Matter," said new section to read as follows:

Section 13-36. Regulations as to Pollution from Boats at Marinas
in Baltimore County.

a. Definitions. As used in this Act, the following words shall have
the following meanings:

1.   "Boat" means any vessel or watercraft moved by oars, paddles,
sails, or other power mechanism, inboard or outboard, or any other vessel
floating upon the water whether or not capable of self-locomotion.

2.   "Waters of Baltimore County" means all outdoor streams, lakes,
marshes, ponds, water courses, waterways and all other bodies or accumu-
lations of water, natural or artificial, public or private.

3.  "Pollution" means any alteration of the physical, chemical, or bio-
logical properties, of any waters in Baltimore County, including change
in temperature, taste, color, turbidity, or odor of the waters, or such
discharge of any liquid, gaseous, solid, radioactive, or other substance
into any waters of the County as will or is likely to create a nuisance
