and where conditions are such as to eliminate or discourage non-local
traffic and street parking, the Planning and Zoning Officer may waive
the requirement of sidewalks on one or both sides. Sidewalks shall not
be required in acreage lot subdivisions (one acre+ ).

Section 13-118 STREET LIGHTING

When required, Street Lighting shall be provided of a design SUB-
MITTED BY THE SUBDIVIDER AND approved by the Planning and
Zoning Office and shall be placed in a location approved by the Department
of Public Works at the expense of the subdivider AND INCORPORATED
IN THE PUBLIC WORKS AGREEMENT.

Section 13-119 STREET TREES

New trees which are indigenous to the area OR OTHER APPROVED
SPECIES will be required to be planted within the right-of-way or on
the lot within five (5) feet of the front property lines in subdivision
which are lacking in trees, or in which substantial loss of trees has or
will occur in the process of street OR LOT construction. Such trees
shall be preferably of a hardwood variety. Such trees shall be planted
in fertile or fertilized ground, and shall be watered and nurtured after
planting until growth is assured. The developer shall be responsible
for such trees for one (1) year after planting. Such trees shall have a
minimum diameter of trunk of at least two and one-half (2˝) ONE AND
ONE-HALF (1˝) inches at a point six (6) feet DIAMETER BREAST
HEIGHT AND A MINIMUM OF SIX (6) FEET HIGH above ground
level, and shall be planted at intervals of no less than forty feet or more
than one hundred (100) feet, all in accordance with a planting plan
to be approved by the Planning and Zoning Office. The planting is to be
secured by a Public Works Agreement. The proposed location and the
species of tree to be used must be submitted for Planning and Zoning
Office approval. In order to prevent heaving of sidewalks and curbs,
trees will ordinarily not be permitted where the planting strip between
side-walks and curbs is less than five (5) feet wide, but shall be placed
inside the property lines, with or without an easement as indicated
by the particular project.

Section 13-120 STREET NAMES AND TRAFFIC CONTROL SIGNS

Street names and traffic control signs of a type meeting FEDERAL
REGULATIONS AND the approval of and in the location designated
by the Public Works Department shall be erected at each street inter-
section. They shall be constructed and installed by the developer or the
Public Works Department at the expense of the subdivider or developer.

Section 13-121 STREET CONSTRUCTION

The subdivider shall provide for the complete construction of streets,
curbs, gutters and sidewalks, in accordance with the Design Manual.
The developer shall be required to repair damage to county roads, STORM
DRAINAGE, CURB, GUTTERS AND SIDEWALKS as a result of
GRADING OR CONSTRUCTION ACTIVITIES IN HIS SUBDIVISION.

Section 13-122 PROCEDURES FOR INSTALLATION OF REQUIRED
IMPROVEMENTS—PUBLIC WORKS AGREEMENT

In all cases the subdivider shall be responsible for the installation
of all required improvements under the supervision INSPECTION of
the Public Works Department at his expense without reimbursement
by the County. The final determination as to the need of the physical
