2546                               Municipal Charters

single-family residential subdivision of four (4) lots or less may be made
with overhead system, provided the "house loop" (secondary service) and
telephone "drop" are installed underground from the property line or
existing pole to the respective residence.

Section 13-115.1 SANITARY SEWERAGE AND WATER SUPPLY

(a) A proposed plat shall be disapproved unless one of the following
provisions is made for disposal of sewage:

(1) Each lot therein is to be provided with a public sanitary sewer.

(2) The WHERE THE County has a plan for extending a public
sanitary sewer system into the area within which the plat is located and
it is established that the area will be served by the public system within
the five (5) year Capital Program. In such a proposed subdivision, capped
sewers shall be installed BETWEEN THE STREET RIGHT-OF-WAY
AND THE STRUCTURE to adequately serve all lots, and every lot therein
IF PUBLIC WATER IS NOT AVAILABLE shall have an area of at
least twenty thousand (20,000) square feet and an average width of at
least one hundred (100) feet. In the event that design information in
such areas is not available from the Department of Public Works, a trust
agreement and escrow fund shall be filed with the Department of Public
Works in the amount of the area service charge and connection charges
CAPITAL CONNECTION CHARGE for each lot owner. THE ESCROW
FUNDS FOR EACH LOT WILL BE CREDITED TOWARD THE FU-
TURE CONNECTION CHARGE FOR THE LOT; SUCH CHARGE MAY
CHANGE BETWEEN THE TIME OF DEVELOPMENT AND THE
TIME OF SEWER CONSTRUCTION.

(3)    A privately operated sewage collection system, approved by the
County Health Department, the State Department of Health, and the
County Department of Public Works, is to be installed. Provided that a
public water system is also available, lot areas may then be reduced to the
minimum size applicable under the Zoning Regulations. Any plat will be
disapproved unless the private sewage collection system is designed to
connect with a public sewage treatment facility, scheduled in the Plan
for Water and
Sewage or 5-year Capital Program.

A PRIVATELY OPERATED INTERIM SEWAGE COLLECTION
AND TREATMENT SYSTEM, APPROVED BY THE COUNTY
HEALTH DEPARTMENT, THE STATE DEPARTMENT OF HEALTH
AND THE COUNTY DEPARTMENT OF PUBLIC WORKS, IS TO BE
INSTALLED. PROVIDED THAT A PUBLIC WATER SYSTEM IS ALSO
MADE AVAILABLE, LOT AREAS MAY THEN BE REDUCED TO THE
MINIMUM SIZE APPLICABLE UNDER THE ZONING REGULA-
TIONS. ANY PLAT WILL BE DISAPPROVED UNLESS THE INTERIM
TREATMENT AND COLLECTION SYSTEM IS SCHEDULED IN THE
WATER AND WASTEWATER TEN YEAR PROGRAM AND/OR THE
FIVE YEAR CAPITAL PROGRAM TO BE CONNECTED WITH OR RE-
PLACED BY A PERMANENT PUBLIC INSTALLATION.

(4)  Every lot therein has an area of at least forty thousand (40,000)
square feet and an average width of at least one hundred fifty (150)
feet AND SERVED BY A SEPTIC SYSTEM, provided that County
agencies agree that there is a reasonable prospect of service by public
sewer and water system within a period of ten (10) years BEYOND
THE FIVE (5) YEAR CAPITAL PROGRAM BUT SCHEDULED WITH-
IN THE TEN (10) YEAR WATER AND WASTEWATER PROGRAM.
If there is no such prospect, the average lot size shall be at least two
