AN ORDINANCE to add new REPEAL AND RE-ENACT, WITH
AMENDMENTS, Section 5 1000 to 5-207 OF the Anne Arundel
County Code (1967 Edition and Supplements), Title 5, "Courts" to
follow immediately after Section 5 915 thereof and to be under the new
subtitle 10, "Pensions of Judges and Their Widows", SUBTITLE 2,
"CIRCUIT COURT," providing a pension for the widow of the late
Judge Paul T. Pitcher, of the Circuit Court for Anne Arundel County.
Whereas, Sections 49 and 50 of Article 26 of the Annotated Code of
Maryland (1966 Replacement Volume and 1968 Accumulative Supplement)
provided for pensions of retired judges of the Circuit Courts for the
several counties, and their widows; and
Whereas, 1969 Senate Bill No. 709 added new Section 5-202A to the
Code of Public Local Laws of Anne Arundel County (1967 Edition) au-
thorizing the County Council of Anne Arundel County to pay a pension
to the widow of any judge of the 5th Judicial Circuit if he served as a
judge at any time during or following the year 1966 and resided in Anne
Arundel County during his service as such; and
Whereas, The late Judge Paul T. Pitcher served as a judge for the
Circuit Court of Anne Arundel County from July 1,1966 until his untimely
death on August 9, 1968, during which time the late Judge Pitcher was a
resident of Anne Arundel County; now, therefore,
Section 1. BE IT ENACTED BY THE COUNTY COUNCIL OF
ANNE ARUNDEL COUNTY, MARYLAND, That new Section 5-1000 be
and it is hereby added to 5-207 OF the Anne Arundel County Code (1967
Edition and Supplements) Title 5, "Courts", to follow immediately after
Section 5-915 thereof and to be under the new subtitle 10, "Pensions of
Judges and their Widows" SUBTITLE 2, "CIRCUIT COURT", BE, AND
IT IS HEREBY REPEALED AND RE-ENACTED, WITH AMEND-
MENTS, and to read as follows:
Section 5 1000 5-207.
(A) EVERY JUDGE OF THE FIFTH JUDICIAL CIRCUIT
ELECTED BY THE QUALIFIED VOTERS OF THE COUNTY, WHO
RESIDES IN THE COUNTY AND WHO REGULARLY SERVES IN
THE CIRCUIT COURT FOR THE COUNTY, WHOSE ACTIVE SERV-
ICE IS TERMINATED, IF HE IS THEN AT LEAST SIXTY YEARS
OF AGE OR WHEN HE BECOMES SIXTY YEARS OF AGE, SHALL
BE PAID A PENSION FOR LIFE BY THE COUNTY CALCULATED
AT THE RATE OF THREE HUNDRED AND SEVENTY-FIVE DOL-
LARS PER ANNUM IN ADDITION TO THE PENSION RECEIVED
FROM THE STATE UNDER STATE LAW, FOR EACH YEAR OF
