Department upon written demand signed by the Chief of Police or his
designee. Notwithstanding anything to the contrary, said item shall be
returned to the pawnbroker if for any reason such identification has been
proven erroneous.
Section 12-1807.
It shall be unlawful for any licensed pawnbroker to extend a loan on
pledge merchandise to TRANSACT ANY BUSINESS (AS DEFINED IN
SECTION 12-1801) WITH any persons obviously under the influence of
intoxicating liquors or drugs OR UNDER EIGHTEEN (18) YEARS OF
AGE.
Section 12-1808.
It shall be unlawful for any licensed pawnbroker to extend a loan
on pledged merchandise to any person under eighteen (18) years of age
TRANSFER, OR IN ANY WAY DISPOSE OF, ANY PROPERTY LESS
THAN THIRTY (30) DAYS AFTER THE FINAL DATE FOR REDEMP-
TION OR REPURCHASE; EXCEPT THAT THE PERSON PLEDGING
OR ORIGINALLY SELLING SAID PROPERTY TO THE PAWN-
BROKER MAY REDEEM OR REPURCHASE SAME WITHIN SAID
THIRTY (30) DAY PERIOD.
Section 12-1809.
Any pawnbroker who shall violate any of the provisions of this sub-
title shall be deemed guilty of a misdemeanor, and shall, upon conviction
thereof, be fined up to $500 or be sentenced to not more than six (6)
months imprisonment, or both.
Section 12-1810.
A violation of any of the provisions of this Ordinance shall be cause
for revocation of license, notwithstanding the fact that the same violation
may constitute a misdemeanor.
Section 2. AND BE IT FURTHER ENACTED, That if any provision
of this Ordinance or the application thereof to any person or circumstance
is held invalid for any reason, such invalidity shall not affect the other
provisions or any other application of this Ordinance which can be given
effect without the invalid provisions or application, and to this end, all
provisions of this Ordinance are hereby declared to be severable.
Section 3. AND BE IT FURTHER ENACTED, That this Ordinance
shall take effect forty-five (45) days from the date it becomes law.
