2276                               Municipal Charters

immediately after the present Section 8-26, said new section to provide
condemnation powers for the Mayor and Common Council of Capitol
Heights, Maryland.

Section 1. BE IT RESOLVED, ENACTED and ORDAINED by the
Mayor and Common Council of Capitol Heights, Maryland, that a new
section be added to the Code of Public Local Laws of Prince George's
County, Maryland (1963 Edition), said new section to be entitled,
"Condemnation," and to be known as Section 8-26-A, and to follow im-
mediately after the present Section 8-26, said new section to read as
follows:

8-26-A. Condemnation.

The Mayor and Common Council shall have the power to condemn
property of any kind, or interest therein or franchise connected therewith,
in fee or as an easement, within the corporate limits of the Town, for any
public purpose. Any activity, project, or improvement authorized by the
provisions of this Charter or any other State law applicable to the Town
shall be deemed to be a public purpose. The manner of procedure in case
of any condemnation proceeding shall be that established in Article 33A
of the Annotated Code of the Public General Laws of Maryland (1957
Edition, as amended), titled, "Eminent Domain."

BE IT FURTHER RESOLVED, ENACTED and ORDAINED that
any section or sections of the Charter of the Town of Capitol Heights,
Maryland, which are inconsistent with the above enacted section, be and
the same are hereby repealed.

BE IT FURTHER RESOLVED, ENACTED and ORDAINED that
the aforegoing proposed amendment shall be posted in the Town Hall for
a period of at least forty (40) days following its adoption, and shall
further be published in The Enquirer-Gazette once in each of four succes-
sive weeks before the 20th day of December, 1969.

BE IT FURTHER RESOLVED, ENACTED and ORDAINED that
the proposed amendment will become and be considered a part of the
Municipal Charter of the Town of Capitol Heights on the 30th day of
December, 1969, unless a petition is filed pursuant to Article 23A, Section
13, of the Annotated Code of Maryland, 1957 Edition as amended, said
petition to be filed on or before the 20th day of December, 1969.

BE IT FURTHER RESOLVED, ENACTED and ORDAINED that
the aforegoing Resolution and Ordinance be and the same is hereby
adopted this 10th day of November, 1969.
