(3) Is mentally defective or mentally ill.

(m) "Detention" means the temporary care of children, who,
pending court disposition, require secure custody for the protection
of themselves or the community, in physically restricting facilities.

(n) "Shelter care" means the temporary care of children in
physically unrestricting facilities, pending court disposition.

(o) "Probation" means a status created by a court order whereby
a minor adjudicated a delinquent child is to remain subject to super-
vision of the court or an agency designated by the court, under
conditions the judge or the agency deems proper.

(p) "Protective supervision" means a status created by a court
order in proceedings whereby a minor is adjudicated in need of
supervision or as mentally handicapped.

(q) "Aftercare supervision" is a status created by a court order
in delinquency proceedings whereby a minor who has previously been
adjudicated a delinquent child and committed to an institution is
released from the commitment under the supervision of an agency
designated by the court under conditions the judge or the agency
deems proper.

(r) "Guardianship of the person of a child or minor" means the
duty and authority to make major decisions in matters having a
permanent effect on the life and/or development of the child or
minor and his general welfare.

(s) "Legal custody" means a status created by a court order
which vests in the custodian the right to have physical possession
and control of a child or minor and to determine where and with
whom he lives and the right to consent to ordinary medical care sub-
ject to the powers, rights, duties, and responsibilities of the guardian
of a person of the child or minor and subject also to any residual
parental rights and responsibilities. When an individual is granted
legal custody, he shall exercise the rights and responsibilities per-
sonally, unless otherwise authorized by the court.

(t) "Residual parental rights and responsibilities" means those
rights and responsibilities remaining with the parent after the trans-
fer of legal custody or guardianship of the person, including, but
not limited to, the right to reasonable visitation, consent to adoption,
the right to determine the child's religious affiliation, and the respon-
sibility for support;

(u) "Commit" means to transfer legal custody;

(v) "Custodian" means a person, or agency, other than a parent
or legal guardian to whom legal custody of the child has been given
by order of the court.

(w) "Intake consultant" is that person assigned by the Depart-
ment of Juvenile Services to the respective juvenile courts to provide
the intake services set forth in this subtitle.

(x) "Adjudicatory hearing" means a hearing to determine the
truth of the allegations in the petition.

(y) "Disposition hearing" is a hearing to determine (1) whether
the child is in need of supervision, treatment, or rehabilitation; and
if so, (2) the nature of the supervision, treatment, or rehabilitation.
