2038                             Laws of Maryland                       Ch. 730

(c)    "Child" means a person who has not reached his 18th birth-
day, except in Baltimore City, where, until July 1, [1970] 1971,
"child" means a person who has not reached his 16th birthday.

(d)    "Adult" means a person who has reached his 21st birthday.

(e)    "Party" means a child named in a petition, or his parent,
guardian or custodian.

(f)     "Judge" means the judge exercising juvenile court juris-
diction.

(g)    "Delinquent act" means an act which is in violation of Arti-
cle 66½ of this Code, any other traffic violation, or an act which
would be a crime if done by a person who is not a child.

(h) "Delinquent child" means a child who commits a delinquent
act and who requires supervision, treatment, or rehabilitation.

(i) "Child in need of supervision" means a child:

(1)    Subject to compulsory school attendance who is habitually
and without justification truant from school;

(2)    Without substantial fault on the part of his parents, guard-
ian, or other custodian, who is habitually disobedient, ungovernable,
and beyond their control.

(3)    Who so deports himself as to injure or endanger himself
or others; or

(4)    Who has committed an offense applicable only to children;
and

(5)    Requires guidance, treatment, or rehabilitation.

(j) "Neglected child" means a child who requires the aid of the
court; and either

(1)    Has been abandoned or deserted by his parents, guardian or
other custodian; or

(2)    Whose parent, guardian, or other custodian legally respon-
sible for his care does not adequately supply him with food, clothing,
shelter, education, medical or other remedial care recognized by
State law or other care or control although financially able, or offered
the financial means to do so; or

(3)    Who suffers or is likely to suffer serious harm from an
improper home environment or guardianship, including the lack of
moral supervision or guidance, of his parents, guardian or custodian.

(k) "Dependent child" means a child who has been deprived of
adequate support or care by reason of the death, continued absence
from the home, or physical, mental or emotional incapacity or dis-
ability of his parent, guardian, or other custodian.

(1) "Mentally handicapped child" means a child who:

(1)    Is or may be expected to be partially or totally incapacitated
for education or remunerative occupation because of retarded mental
development or severe emotional disturbance ;

(2)    May be a danger to himself or the person or property of
others due to severe emotional disturbance; or
