All that portion of the St. Mary's River and tributaries bounded
on the north by that point on the St. Mary's River which is
traversed by State Highway 5, this point being south of the town
of Great Mills and bounded on the south by a straight line running
from Chancellor Point at low mean tide and traversing westward to
the northernmost construction of land at the mouth of Cooper Creek
at mean high tide which is north of the general area known as
Calloway Landing. THAT PART OF THE ST. MARY'S RIVER
ABOVE SEMINARY POINT DESCRIBED IN REGULATIONS
OF THE DEPARTMENT OF NATURAL RESOURCES SHALL
BE KNOWN AS THE "ST. MARY'S RIVER WILD FOWL SANC-
TUARY," HEREINAFTER REFERRED TO AS THE SANC-
TUARY.
164B.
It is unlawful for any person to hunt, pursue, kill, take or attempt
to hunt, pursue, kill or take any wild fowl within the boundaries
of the Sanctuary as defined in Section 164A of this subheading.
EXCEPT AS PERMITTED BY REGULATION OF THE DEPART-
MENT OF NATURAL RESOURCES. It is unlawful for any person
to have in his possession when within the boundaries of the Sanc-
tuary any contrivance designed for use in taking wild fowl* EXCEPT
AS PERMITTED BY REGULATION OF THE DEPARTMENT
OF NATURAL RESOURCES.
164C.
The Sanctuary as provided for in this subsection is placed under
the control and supervision of the Department of Natural Resources
of this State and this department has the power to make rules and
regulations for the supervision of the Sanctuary and to patrol and
enforce the provisions of this subsection and any regulations which
may be formulated by it.
164D.
Any person convicted before any justice of the peace of this
State for violating any of the provisions of this subheading or any
of the rules and regulations formulated in accordance with the pro-
visions thereof, shall be fined not less than twenty-five dollars
($25.00) nor more than fifty dollars ($50.00) and costs for each and
every offense.
Nothing in this subsection shall be construed to prohibit persons
duly authorized by written permits from the Department of Na-
tural Resources to hunt, pursue, kill or take wild fowl for scientific
purposes or for the control of undesirable wild fowl.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1970.
