(3) Surety company means any company designated as such by
the provisions of subtitle 29 of article 48A of this code, as amended
from time to time.

(b)    Any surety company in any year may become surety in an
amount not to exceed $200 in any one incident with respect to any
guaranteed bail bond certificates issued in that year by an auto-
mobile club, association, or insurance company authorized to write
automobile liability insurance within this State by filing with the
State Insurance Department of Maryland an undertaking thus to
become surety.

(c)    No guaranteed bail bond certificate shall be delivered or is-
sued for delivery in this State unless the form has been filed with
and approved by the Insurance Commissioner. At the expiration of
30 days after the form has been filed, it shall be deemed approved
unless prior thereto it has been affirmatively approved or disapproved
by order of the Insurance Commissioner. Any order of the Insur-
ance Commissioner disapproving the form or withdrawing previous
approval shall state the grounds therefor.

(d)    No guaranteed bail bond certificate shall be acceptable as
a part of or as a contribution to any surety undertaking or bail
bond requirement of an amount in excess of $200.

(e)    Any guaranteed bail bond certificate with respect to which
a surety company has become surety, when posted by the person
whose signature appears thereon, shall be accepted in lieu of cash
bail or other bond in an amount not to exceed $200 as a bail bond,
to guarantee the appearance of the person in any court in this State,
including all municipal courts in this State, People's Court and Trial
Magistrates, at a time required by the court, when the person is
arrested for violation of any motor vehicle law of this State or any
motor vehicle ordinance of any county or municipality in this State
except for the offense of driving in an intoxicated condition or while
driving ability is impaired by the consumption of alcohol, under-
taking to drive a vehicle while under the influence of any narcotic
drug or any other drug to a degree which renders the person in-
capable of safely driving a vehicle, or for any felony committed
prior to the date of expiration shown on the guaranteed bail bond
certificates. Any guaranteed bail bond certificate so posted as bail
bond, in any court in this State shall be subject to the forfeiture
and enforcement provisions with respect to bail bonds in criminal
cases as otherwise provided by law or as hereafter may be provided
by law, and any guaranteed bail bond certificate posted as a bail
bond in any municipal court of this State shall be subject to the
forfeiture and enforcement provisions, if any, of the charter or ordi-
nance of the particular county or municipality pertaining to bail
bonds posted. The provisions of this section are to apply both to
resident and non-resident persons.

§ 16-108. Arrest of nonresident.

(a) All of the provisions of this subtitle apply both to residents
and nonresidents of this State, or of a state which does not have a
reciprocal agreement with the State of Maryland except the special
provisions in this section which shall govern in respect to nonresidents
under the circumstances herein stated.
