Secretary shall also have the power, in his discretion, to remove the
name of any person from an eligible list for any wilful misrepresen-
tation of a material matter made in an application for examination to
establish an eligible list. A new eligible list for any class shall be
combined with an existing list as the [Commissioner] Secretary
may by rules provide but in such case any portion of such combined
list shall be automatically cancelled one year after being first posted
unless held in force as above provided. The markings and examina-
tion papers of each candidate shall be open to his inspection upon
application at the office of the [Commissioner] Secretary. When-
ever the name of any person shall have been certified to five (5)
different vacancies (excluding any certification in which the name of
a veteran having preference to appointment, as provided in Section
17 of this article, shall stand higher than the name of such person),
and such person shall not have been selected by an appointing
authority to fill any of the vacancies to which he was certified for
appointment, the [Commissioner] Secretary may, if he deems such
person to be unsuitable for employment, cause the name of such
person to be dropped from the list of eligibles. Such person shall be
notified in writing of such action. A candidate who protests removal
of his name from the list shall be entitled to a review of such action
by a board established under the rules of the [Commissioner]
Secretary to review such actions and to advise the [Commissioner]
Secretary with respect to such review of such action.

(b) If the [Commissioner] Secretary receives a requisition for
the appointment of a person to a permanent position for which no
eligible list exists he shall forthwith call an examination and he may
if necessary to prevent the stoppage of public business, and not
otherwise, certify a qualified person for temporary appointment, with
or without examination, and such person shall be appointed by the
appointing authority, provided, however, that such temporary ap-
pointment shall be pending the establishment of an eligible list
only.

24.

(a)    Application to [Commissioner] Secretary for temporary
appointment.—When from pressure of work an extra position must
be established for a period not exceeding six months, the appointing
authority shall make requisition upon the [Commissioner] Secretary
of Personnel
for the appointment of an extra employee stating the
duties to be performed and the probable length of employment. The
[Commissioner] Secretary of Personnel shall authorize the ap-
pointment of, with or without competitive examination, a qualified
person; provided, however, that so far as practicable appointment
to extra positions shall be made from the eligible lists; and provided
further that no such appointment shall be made for a period exceed-
ing six months.

(b)    An appointing authority or any officer authorized by an
appointing authority may, to prevent the stoppage of the public
business when an emergency arises and time will not permit of the
securing of the consent of the [Commissioner] Secretary and the
appointment by him of a person, appoint any qualified person during
the emergency for a period not exceeding sixty days. Persons thus
appointed shall be known as emergency employees. Prompt report
shall be made to the [Commissioner] Secretary of emergency ap-
