or more immediately preceding the date on which such veteran takes
any merit system examination, shall be given special credit for such
service; provided, such veterans served a minimum of ninety days
in the service of the United States, as aforesaid, or were discharged
by reason of a disability incurred in line of duty. Such war veterans
who are disabled as a result of their war service shall be given a
credit of ten points in all examinations for appointments. Nondis-
abled veterans shall be given a credit of five points in all examina-
tions for appointment. All such credit shall be allowed only in
determining the standing on the certification of eligibles of said
veteran.
(e) Promotion is a change from one class to another class with
a higher maximum compensation, and vacancies shall be filled by
promotion as far as is consistent with the best interests of the classi-
fied service, in the judgment of the [Commissioner] Secretary.
Unclassified employees shall have the same right as classified em-
ployees to take promotional examinations for positions in the classi-
fied service, providing they have the necessary qualifications; and
shall also have the right to be temporarily appointed to such positions,
when qualified, under the provisions of Section 24(a) of this article.
(f) The [Commissioner] Secretary shall control all examina-
tions and may designate as special examiners any officers or em-
ployees of this State or any other person not in the service of this
State to conduct and hold such examinations as the [Commissioner]
Secretary may direct and to make return and report thereof to him.
The [Commissioner] Secretary shall have power to review the find-
ings in all such reports, and may order new examinations if he deems
such action desirable. The [Commissioner] Secretary may at any
time substitute any other person in the place of any person so
designated and may himself conduct such examinations without
designating special examiners.
(h) (i) Any person who for a period of one year has been em-
ployed continuously (including any period during which he was not
so employed due to no fault of his own) by the State Roads Com-
mission as a maintenance man, or on roadside beautification work,
or a member of the State Roads Commission weighing crews, may
apply to the [Commissioner] Secretary of Personnel for classi-
fication as a highway maintenance man.
(ii) If the applicant satisfies the [Commissioner] Secretary of
Personnel (1) that he has been continuously employed in main-
taining State roads and/or county roads, or on roadside beauti-
fication work, under State supervision during the preceding one year
(including any period during which he was not so employed due to
no fault of his own) and (2) that he is qualified as a highway
maintenance man, then the [Commissioner] Secretary of Personnel
shall certify the name of the applicant to the State Roads Commis-
sion as eligible for appointment as a highway maintenance man,
and any man so appointed shall become a part of the classified
service.
(iii) All persons employed by the State Roads Commission in
the classification of "highway maintenance man," as of June 1,
1961 shall become part of the classified service without further
examination.
