the terms of this article, a position in the classified service, but
shall not include a person employed by contract to render a tempo-
rary special service for the State where such contract is certified
by the [State Commissioner] Secretary of Personnel to be for a
service that could not in his judgment be rendered by a person in
the classified service. "Class of position" or "class" means a group,
established under the article of positions similar in respect to the
duties and responsibilities thereof and the qualifications required
therefor. "Classification title," "class title," or "title" means the
designation given, under this article, to a class and to each position
in the class and to the employee in each position in the class.
"Appointing authority" means any commission, board or officer
having power to make appointments.

[There shall be appointed by the Governor a person of ability and
integrity who shall be known as the State Commissioner of Person-
nel. The present Commissioner of State Employment and Registra-
tion shall become the State Commissioner of Personnel. As of June
1, 1955, and each sixth year thereafter, the Governor shall appoint
a Commissioner of Personnel for a term of six years and until his
successor is appointed and qualified. Any vacancy shall be filled by
the Governor for the unexpired term. The Governor may remove
the Commissioner for official misconduct, incompetency, or neglect
of duty. The Commissioner shall receive a salary as provided in
the budget.]

[The Commissioner shall appoint a secretary who shall perform
such duties as the Commissioner may prescribe, and who shall re-
ceive the salary appropriated in the budget bill.] The [Commis-
sioner] Secretary of Personnel may appoint his employees and may
incur expenses for office rent, printing, advertising, stationery, sal-
aries of employees and other expenses incidental to the administra-
tion of this article, within the limits of the amounts appropriated
therefor by the General Assembly in the budget bill.

The employees of the [Commissioner excluding his secretary]
Secretary of Personnel, except as provided in Article 41 of this Code
or otherwise provided by law,
shall be included in the classified
service.

The [Commissioner] Secretary of Personnel shall make an annual
report on or before January 1st in each year to the Governor con-
cerning his work and proceedings and shall include therein any
recommendations he deems advisable in regard to conditions in
service of the State—classified and unclassified. All rules of the
[Commissioner] Secretary of Personnel shall be open to public
inspection at the office of the [Commissioner] Secretary.

Wherever in this article the words "Commissioner" or "Secretary"
appear[s], [it] they shall be deemed to mean and shall refer to
the [State Commissioner] Secretary of Personnel; and wherever
in this Code the words "State Employment Commissioner" or "Com-
missioner of State Employment and Registration" appear, they shall
be deemed to mean and shall refer to the [State Commissioner]
Secretary of Personnel.
