Part IVSuspension and Revocation of Licenses
under the Point System

§ 6-4.01. Point system to be established.

(a)    In addition to, but not in substitution for any other provi-
sions of this article, the commissioner after notice to the general
public shall put into effect a point system for the suspension or rev-
ocation of drivers' licenses issued under this article. Points shall be
charged against a licensee after conviction of violation of the motor
vehicle laws or regulations of this State or of local authorities and
for the purpose of this part forfeiture of collateral shall be con-
sidered as a conviction.

(b)    The point system heretofore in effect, as established by the
commissioner, shall remain in effect except insofar as it is inconsist-
ent with the provisions of this part, until modified or repealed by
the commissioner.

§ 6-402. Initial points.

(a) Initial points shall be assessed as follows:

Any moving violation not listed below and not contrib-
uting to an accident
............................................................    1 Point

Negligent Driving ..................................................................   1 Point

Violations contributing to an accident ............................    3 Points

Speeding in excess of the posted speed limit by 10 miles

per hour or more..................................................................    3 Points

2  POINTS
Speeding in excess of the posted speed limit by 20 30 miles

per hour or more ................................................................    5 Points

Failure to report an accident ..............................................    5 Points

Permitting unlicensed operator to operate a motor vehicle   5 Points

Operating without a license ................................................    5 Points

Operating on an instruction and examination license un-
accompanied
........................................................................    5 Points

Participating in a racing or speed contest on the public

highways ..............................................................................    5 Points

Violation of restriction on license..........................................   5 Points

Reckless driving ......................................................................    3 Points

Driving while ability impaired by consumption of alcohol   6 Points
Leaving after colliding:

No personal injury ............................................................    8 Points

With personal injury ........................................................ 12 Points

Operating after refusal, suspension, cancellation, or
revocation
.............................................................................. 12 Points

Obtaining or attempting to obtain a permit by misrepre-
sentation
.............................................................................. 12 Points

Lending, borrowing, or altering a permit ........................ 12 Points

Conviction for any homicide or assault committed by
means of an automobile
...................................................... 12 Points

Driving in an intoxicated condition or under the influence

of narcotic drugs or any other drug................................ 12 Points
