"Washington Suburban Transit District," and Section 72-5 (a) of
the Code of Public Local Laws of Montgomery County (being Article
16 of the Code of Public Local Laws of Maryland) (1965 Edition)
title "Montgomery County," subtitle "Washington Suburban
Transit District," be and they are hereby repealed and reenacted, with
amendments, to read as follows:
83A-5.(a)(72-5(a))
The Commission shall be composed of [six] seven members,
three to be appointed by the County Council of Montgomery County
[and], three by the Board of County Commissioners of Prince
George's County [.] and the Secretary of Transportation who shall
be an ex-officio member and who shall be entitled to the same rights
of membership as the appointed members. At least one commissioner
from each county shall be appointed from among the members of
the County Council and the Board of County Commissioners. The
other commissioners may be selected from among the members of
the respective governing bodies or may be selected from qualified
residents of each county as the County Council and the Board
of County Commissioners see fit. Each commissioner who shall be
appointed from among the members of the County Council and the
Board of County Commissioners shall serve at the pleasure of his
respective appointing body. Commissioners who are not appointed
from the members of the County Council and the Board of County
Commissioners shall be appointed for a period and term of three
years, provided, however, that except for Commissioners who
have been appointed as of March 15, 1966, and who are not mem-
bers of the respective governing bodies, Commissioners shall be ap-
pointed for a three-year term and period by the respective govern-
ing bodies duly elected at the 1966 General Election. Members of
the Commission shall serve until their successors have been ap-
pointed and qualified. The governing bodies of each of the counties
shall inform the Commission of its appointments to and removals
from the Commission by delivering to the Commission a certified
copy of the resolution or other action making the appointment or
causing the removal.
Sec. 14. And be it further enacted, That all persons who are,
as of June 30, 1971, members officers and employees of all boards
and commissions included within the Department of Transporta-
tion are hereby confirmed in the office, position and classification
which they hold as of June 30, 1971, as members, officers and
employees of such boards and commissions, except as otherwise
provided in this Act or until they retire, resign or are removed
as provided by law, or until the terms to which they were ap-
pointed expire. AS OF JUNE 30, 1971, CLASSIFIED EMPLOYEES
OF ANY DEPARTMENTS, BOARDS, COMMISSIONS, OFFICES,
OR AGENCIES WHICH CONSTITUTE PARTS OF THE DE-
PARTMENT OF TRANSPORTATION, SHALL RETAIN THEIR
MERIT SYSTEM STATUS, EXCEPT AS OTHERWISE SPECIFI-
CALLY PROVIDED IN THIS ACT.
Sec. 15. And be it further enacted, That all books, papers, files,
records, furniture, fixtures, and all other personal property owned
by or in the custody, as of June 30, 1971, of any agency abolished
by this Act, shall be transferred to and be in the ownership or
custody of its successor agency.
