istrator whose office is established by Article 41, Section 207D, of
this Code;

4.

[There is hereby created the Metropolitan Transit Authority, a
body corporate and politic, as] The Public Transit Administration
established pursuant to Article 41, Section 207D of this Code is
an
instrumentality of the Department of Transportation of the State,
[which] and, subject to the authority of the Secretary of Trans-
portation and the Maryland Transportation Authority set forth in
Articles 41 and 94A of this Code or elsewhere in the laws of Mary-
land, the Administration
shall have the powers and duties granted in
this article, as amended from time to time, and such additional pow-
ers as may hereafter lawfully be conferred upon it pursuant to law,
to manage, conduct and control the functions, affairs and property
of the [corporation] Administration.

The powers, authority and functions vested in the Public Transit
Administration by the provisions of Sections 6, 8(c) through 8(n),
18, 23, 29, 31, 34, 35, 36, 37, 44, 45 and 46 of this Article, shall be
exercised or performed by the Administration subject to the approval
of the Secretary of Transportation or, with respect to matters within
the jurisdiction of the Maryland Transportation Authority, the ap-
proval of the Maryland Transportation Authority. However, the
Secretary or the Maryland Transportation Authority, by regulations
or directives, may dispense with such power of approval, and author-
ize the Administration to proceed pursuant to such sections without
obtaining prior approval, to the extent that the Secretary or Author-
ity deem appropriate.

(a)    The [board] Administration shall appoint and employ a
[general manager and a] general counsel, whose compensation shall
be fixed and determined by the [Authority] Administration, who
shall [be hired on a full-time basis and who shall] serve at the
pleasure of the [Authority] Administration.

(b)    The [general manager] Public Transit Administrator shall
be the chief administrative officer of the [Authority] Administra-
tion
and, subject to policy direction by the [board] Secretary of
Transportation,
shall be responsible for all activities of the [Author-
ity] Administration. All employees and all officers, [other than
those specified in Section 5] shall be appointed and removed by the
[general manager] Administrator under such rules of procedure and
standards as the [board] Secretary of Transportation may deter-
mine.

8.

(f) Grants, loans, advances, etc.—To apply for, receive and ac-
cept grants, gifts, payments, loans, advances and other funds, appro-
priations, properties and services from the United States, the State
of Maryland, or any agency or political subdivision thereof, or from
any other public or private corporation, organization or person, and
enter into agreements with respect thereto and for any studies, plans,
