two (32)] forty eight (48) FORTY-TWO (42) days of racing. The
Commission shall promptly pay all taxes collected under the provisions
of this section to the Comptroller. Each licensee licensed under the
provisions of this section shall, in addition to the other taxes and fees
imposed under the provisions of this article, pay annually to the
Maryland State Fair Board a sum representing one-tenth of one
per centum of all money wagered in excess of two million dollars
($2,000,000) with a maximum of three thousand five hundred dollars
($3,500.00) from each licensee.
(b) (1) In addition to the aforegoing, each licensee licensed under
the provisions of this section, and having a total wager not in excess
of $166,666.67 daily average on all races conducted by it during the
year, shall retain for its own use in the year 1970 and in each calendar
year thereafter one per centum (1%) of all money wagered, to be
expended equally upon increased purses and physical improvements
to its racing facilities, as approved by the State Racing Commission.
SEC. 2. AND BE IT FURTHER ENACTED, THAT THIS ACT
IS HEREBY DECLARED TO BE AN EMERGENCY MEASURE
AND NECESSARY FOR THE IMMEDIATE PRESERVATION
OF THE PUBLIC HEALTH AND SAFETY AND HAVING BEEN
PASSED BY A YEA AND NAY VOTE, SUPPORTED BY THREE-
FIFTHS OF ALL THE MEMBERS ELECTED TO EACH OF THE
TWO HOUSES OF THE GENERAL ASSEMBLY, THE SAME
SHALL TAKE EFFECT FROM THE DATE OF ITS PASSAGE.

AN ACT to repeal and re-enact, with amendments, Sections 211H(b)
and 211Q(a) of Article 89B of the Annotated Code of Maryland
(1969 Supplement), title "State Roads," subtitle "Expenditure of
Commission's Funds and Programming and Scheduling of High-
way Projects," to provide that rights-of-way for future State
Police post sites related to certain highways be financed by and
under the provisions applicable to the "Right-of-Way Revolving
Fund" AND TO PROVIDE FOR REPAYMENT, WITH INTER-
EST, OF FUNDS ADVANCED FOR THE PURPOSE OF
ACQUIRING STATE POLICE SITES.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 211H(b) and 211Q(a) of Article 89B of the An-
notated Code of Maryland (1969 Supplement), title "State Roads,"
subtitle "Expenditure of Commission's Funds and Programming and
Scheduling of Highway Projects," be and they are hereby repealed
and re-enacted, with amendments, to read as follows:
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1970.
