CHAPTER 515
(House Bill 1281)

AN ACT to repeal and re-enact, with amendments, Section 16 of
Article 66˝ of the Annotated Code of Maryland (1969 Supple-
ment), title "Motor Vehicles," subtitle "Administration—Regis-
tration—Titling," authorizing the Commissioner to destroy any
driver's record which shows no convictions for a period of ten
years.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 16 of Article 66˝ of the Annotated Code of Mary-
land (1969 Supplement), title "Motor Vehicles," subtitle "Adminis-
tration—Registration—Titling," be and it is hereby repealed and
re-enacted, with amendments, to read as follows:

16.

The Commissioner may microfilm any records of the Depart-
ment at any time he deems proper or destroy any records of the
Department, which have been maintained on file for three (3)
years, which he may deem obsolete and of no further service in
carrying out the powers and duties of the Department except records
of criminal and motor vehicle violations which show refusal, or re-
vocation of license and/or registration within the preceding ten
years
as a result of a conviction under the provisions of Section
104(a) of this article, showing mandatory refusal or revocation.
If an operator's or chauffeur's record shows no criminal or motor
vehicle convictions for a period of ten years, the driving record
of such driver may be destroyed regardless of previous refusals
or revocations of license and/or registration.
If an operator's or
chauffeur's record shows only one suspension and there have been
no subsequent motor vehicle convictions for a period of five years,
or if an operator's or chauffeur's record shows only one revocation
and it resulted from a violation of the provisions of Section 104(b)
of this article, prior to its amendment by Chapter 677 of 1963, and
there have been no subsequent motor vehicle convictions for five
years the driving record of such driver may be destroyed. Driving
records of deceased persons may be destroyed three (3) years after
the date of death shown on any official notice of death which has
been received by the Department.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1970.
