cants. The list for any such appointment shall be completed not less
than three weeks prior to the date the county governing body makes
the actual appointment. The list of applicants shall be open to the
public for inspection from the time of commencement of making the
list until an appointment therefrom is made. In the event a county
governing body does not appoint an individual from the names on
the list, or if no name appears on the list, then the county govern-
ing body shall provide for the preparation of a second list and follow
the procedure applicable to the first list, with the above-mentioned
three week period commencing with the closing of such second list.
(c) Removal for cause. A county governing body may remove
for cause, prior to the expiration of the term for which a Commission
member was appointed, any member of the Commission appointed
by that county governing body. In such a case, the cause for re-
moval shall be stated in writing and a public hearing held thereon.
At such a hearing an opportunity shall be given to the Commission
member in question to present a defense in his or her own behalf.
In Montgomery County, the removal of members of the Commission
by the County Executive shall be subject to the approval of the
County Council. Any vacancy occurring in the membership of the
Commission for any reason shall be filled as provided in this section
for the unexpired portion of the term.
(e) Certain procedures. The Commission shall engage and or-
ganize a staff so as to efficiently accomplish the matters within its
jurisdiction, as set forth in Section 83-57A (71-4A). All acts, orders
and regulations heretofore passed by the Commission while sitting
in the District of Columbia are hereby ratified and confirmed and
are to be given the same force and effect as if passed in the State of
Maryland. The Commission shall annually publish in at least one
newspaper in Montgomery County, and one in Prince George's
County, a full and true account of its receipts, expenses and ex-
penditures. The Commission shall employ a certified public account-
ant, certified to practice as a public accountant in the State of Mary-
land, to audit its books and accounts. The Commission shall always
keep available and open to public inspection during business hours, at
its principal office, a detailed audit and financial statement of its
accounts. The Commission shall file with the County Commissioners
of Prince George's County and the County [Council] Executive of
Montgomery County, annually, a certified copy of such detailed audit
and financial statement.
71-6.
(a) Applicability. The provisions of this section shall apply to
all Washington Suburban Sanitary Commissioners appointed, re-
appointed or nominated by the Montgomery County [Council]
Executive under section 71-4 of this Code. The words, "county coun-
cil" as used in this section shall mean the Montgomery County Coun-
cil.
[(c) Interview.
(1) All applicants for appointment, reappointment or nomina-
tion as commissioners of Washington Suburban Sanitary Commission
shall be interviewed by the county council or its designated agent in
private as to any possible or potential conflict of interests. The
