Replacement Volume and 1968 Supplement), to enact Sections 1
through 161, inclusive, in lieu thereof, to enact a comprehensive
new law relating to public education in lieu thereof, and to renum-
ber as part of said new law, without amendment, Sections 108
through 129, inclusive and 177 through 201B, inclusive of said
Article 77 and to repeal Sections 164 through 165J, inclusive; 248
through 248U 248K, inclusive; 170A through 170K, inclusive; 249
through 259AD, inclusive; 260 through 289J 284K, inclusive;
288A; 300 through 309 304C, inclusive; and 325 through 328,
inclusive, and to re-enact said sections without amendment, as
new Article 77A, title "Higher Education."

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 1 through 107, inclusive; 130 through 163, inclusive;
171 through 176, inclusive; 202 through 247, inclusive; 285 through
288, inclusive; 289 through 299, inclusive; 305 through 319 318, inclu-
sive, and 329 and 330 of Article 77 of the Annotated Code of Mary-
land, (1965 Replacement Volume, 1968 Supplement), title "Public
Education" be and they are hereby repealed, and that there be en-
acted in lieu thereof, new Sections 1 through 161, inclusive, of
said Article 77, to read as follows:

Article 77
Chapter 1. Free Schools

1.    Free Schools.

There shall be throughout the State of Maryland a general system
of free public schools, according to the provisions of this article.
"PUBLIC SCHOOLS" AS USED IN THIS ARTICLE SHALL
MEAN SCHOOLS AT THE ELEMENTARY AND SECONDARY
LEVEL.

Chapter 2. State Board of Education

2.    State Board of Education as head of State Department of
Education.

Educational matters affecting the State and the general care and,
supervision of public education shall be entrusted to a State Depart-
ment of Education, at the head of which shall be a State Board of
Education.

3.    State Board of Education.

The State Board of Education shall be composed of seven members,
who shall be appointed from the citizens of the State by the Gov-
ernor for over-lapping terms of seven
FIVE years, from the first
Monday in July next succeeding their appointment, and they shall
hold office until their successors qualify. One member shall be ap-
pointed each year to a full term.
OF THE MEMBERS INITIALLY
APPOINTED, ONE SHALL BE APPOINTED FOR A TERM OF
ONE YEAR, ONE FOR TWO YEARS, TWO FOR THREE YEARS,
ONE FOR FOUR YEARS, AND TWO FOR FIVE YEARS; AND
THEREAFTER ALL TERMS SHALL BE FOR FIVE YEARS.
The members of the Board shall be appointed solely because of their
character and fitness, but no person shall be appointed to the Board
who is in any way subject to its authority, and the Governor and the
State Superintendent of Schools shall not be members of this Board.
