MARVIN MANDEL, Governor 299
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.
Approved April 9, 1969.
CHAPTER 120
(Senate Bill 366)
AN ACT to repeal and re-enact, with amendments, Section 90 (b)
(1) of Article 2B of the Annotated Code of Maryland (1968 Re-
placement Volume), title "Alcoholic Beverages," subtitle "Hours
and Days for Sale," amending the alcoholic beverage laws in order
to remove a meaningless cross reference in the Sunday sale laws
applying in Garrett County.
Whereas, in Section 90 (b) (1) of Article 2B of the Code con-
cerning Sunday sales of alcoholic beverages there is a cross refer-
ence concerning the fine for a violation of these provisions in Gar-
rett County; and
Whereas, this cross reference now is meaningless as the other
section has been amended to remove penalty provisions; and
Whereas, the effect of this change is to make the general penalty
provisions in Article 2B applicable to such violations in Garrett
County; and
Whereas, it is desirable to remove the obsolete and incorrect cross
reference in Section 90 (b) (1) of Article 2B; now, therefore,
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 90 (b) (1) of Article 2B of the Annotated Code of
Maryland (1968 Replacement Volume), title "Alcoholic Beverages,"
subtitle "Hours and Days for Sale," be and it is hereby repealed and
re-enacted, with amendments, to read as follows:
90.
(b) (1) In the jurisdictions in which this subsection is applicable,
it shall be unlawful for anyone to sell or for any licensed dealer to
deliver, give away or otherwise dispose of any alcoholic beverages
on Sunday. Any person selling or any licensed dealer delivering,
giving away or otherwise disposing of such beverages in such juris-
dictions on Sundays shall be guilty of a misdemeanor and, upon con-
viction thereof, shall be fined not exceeding fifty dollars ($50.00) for
the first offense and for each succeeding offense shall be fined not
exceeding one hundred dollars ($100.00), or imprisoned in the county
jail for not more than thirty (30) days, or be both fined and impris-
oned, in the discretion of the court. [In Garrett County the fine for
violation of this section is fixed in Section 98A of this Article.]
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.
Approved April 9, 1969.
