Replacement Volume), title "Budget and Procurement," subtitle
"Department of Budget and Procurement"; and to repeal and
re-enact, with amendments, Sections 17, 18, 19, 21, 21A, 22, 23,
23B, 24, 25, 26 and 27 of Article 15A of the Annotated Code of
Maryland (1957 Edition and 1968 Replacement Volume), title
"Budget and Procurement," subtitle "Budget Bureau," to provide
for the creation in the Executive Branch of Government, a new
department to be known as the Department of Budget and Fiscal
Planning which department is to be headed by a Secretary of
Budget and Fiscal Planning, and to provide for the duties and
responsibilities of said Secretary as well as the personnel of said
department and the duties of said personnel, and to provide that
the Secretary of the Department of Budget and Fiscal Planning
be responsible to advise and counsel the Governor on all matters
assigned to the Department, and to provide that the Secretary
be responsible for the operation of the Department and directed
to establish guidelines and procedures to promote the orderly and
efficient administration thereof; and to provide for the abolish-
ment of the present Department of Budget and Procurement
and the Office of Director of Budget and Procurement, and to
transfer all rights, powers, duties, obligations and functions pres-
ently conferred upon or exercised by the Department of Budget
and Procurement and the Director of Budget and Procurement
to the Secretary of Budget and Fiscal Planning and the Depart-
ment of Budget and Fiscal Planning; and to outline the additional
duties assigned to the Secretary of Budget and Fiscal Planning
which duties are to be in addition to those duties being assigned
and transferred from the existing Department of Budget and
Procurement and Director of the Office of Budget and Procure-
ment to the new Department of Budget and Fiscal Planning and
the Secretary of said Department; and relating generally to the
laws of the State of Maryland dealing with the budgetary process
and fiscal planning of this State.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 71 of Article 41 of the Annotated Code of Maryland
(1957 Edition and 1965 Replacement Volume), title "Governor—
Executive and Administrative Departments," subtitle "Budget and
Procurement," be and it is hereby repealed in its entirety and that
new Section 71 is hereby enacted, to be under the same title but
under the new subtitle "The Department of Budget and Fiscal
Planning," to read as follows:

THE DEPARTMENT OF BUDGET AND FISCAL PLANNING
71.

(a)   The Department of Budget and Fiscal Planning of Maryland
is hereby created as a principal department of the State Govern-
ment. The head of the Department of Budget and Fiscal Planning
