Sec. 9. And be it further enacted by the General Assembly of
Maryland,
That Sections 31, 44, and 44A of Article 43 of the An-
notated Code of Maryland (1957 Edition, 1965 Replacement Volume
and 1968 Supplement), title "Health," subtitle "Miscellaneous Pro-
visions," be and they are hereby repealed and re-enacted, with
amendments, to read as follows:

31.

It shall be the duty of the ([State Board] Commissioner of Health
[to take such action and] to recommend to the Secretary of Health
and Mental Hygiene for adoption
[adopt] and to enforce such rules
and regulations as may be necessary to prevent the introduction of
any infectious or contagious disease into this State, or to prevent
the spread of any infectious or contagious disease whether or not
such disease shall exist within this State at the time of the passage
of this Act, and any person or persons or corporations refusing or
neglecting to obey such rules and regulations, upon promulgation
thereof by the Secretary,
[after due notice thereof,] shall be deemed
guilty of a misdemeanor, and upon conviction thereof shall be fined
not more than five hundred dollars for every such offense. Whenever
necessary, the [State Board of Health] Secretary may call public
conferences of health officers; or may [, by vote of a majority of its
members,] send a delegate to any conference of local, State or na-
tional health officers.

44.

The [State Board] Department of Health and Mental Hygiene is
hereby designated as the agency of the State to administer a pro-
gram of noninstitutional services for mentally ill or those who are
suffering from conditions which may lead to mental illness and to
co-ordinate and supervise the administration of those services in-
cluded in the program which are not administered directly by it.
The purpose of such program shall be to develop, extend and im-
prove services for locating persons who are suffering from some
mental illness and to provide facilities for diagnosis and corrective
treatment of noninstitutional cases.

[Nothing in this section shall be construed to amend or alter in
any way, the rights and powers conferred upon the Department of
Mental Hygiene.]

The [said State Board] Secretary of Health and Mental Hygiene
is hereby authorized:

(a)  To formulate and administer a detailed plan or plans for the
purposes herein specified, and make such rules and regulations as
may be necessary or desirable for the administration of such plans.

(b)   To receive and expend in accordance with such plans, all
funds made available to [such Board] the Department of Health and
Mental Hygiene
by the federal government, the State or its political
subdivisions or from any other sources for such purposes.

(c)   To co-operate with the federal government, through its appro-
priate agency or instrumentality, and all other agencies, both public
and private, in developing, extending and improving such services
