An Act to repeal and re-enact Section 15 of Article 23 of the Code
of Public Local Laws of Wicomico County (1965 Edition) being
Article 23 of the Code of Public Local Laws of Maryland, title
"County Council," subtitle "Payment of Pensions," increasing the
amount from Two Hundred Dollars ($200.00) to Two Hundred Fifty
Dollars ($250.00) per month authorized to be paid to retired em-
ployees of the County who have attained the age of 65 years and
have worked for said County for at least 35 years and whose total
State, Federal and local benefits do not exceed Two Hundred Fifty
Dollars ($250.00) per month.
Section 1. BE IT ENACTED BY THE COUNTY COUNCIL OF
WICOMICO COUNTY, MARYLAND, that Section 15 of Article 23 of
the Code of Public Local Laws of Wicomico County (1965 Edition) being
Article 23 of the Code of Public Local Laws of Maryland, title "County
Council," subtitle "Payment of Pensions," be and it is hereby repealed
and re-enacted with amendments to read as follows:
15. Payment of Pensions.
The County Council of Wicomico County shall have the power and
authority in its discretion, to pay any retired employee of said County
who has been employed by said County for a period of thirty-five years
or more, and has attained the age of sixty-five or over, at the time of
retirement, and who is receiving retirement benefits under the provisions
of any State or Federal law, and/or any retirement annuity provided by
said County Council, where such benefits in the aggregate are less than
[$200.00] $250.00 per month, an additional sum not exceeding the dif-
ference between the aggregate benefit received as aforesaid, and
[$200.00] $250.00 per month, upon application to the County Council,
and said Council shall annually levy an amount sufficient to pay such
additional benefits. In determining the benefit to be paid an employee
hereunder, consideration shall be given to the length of service and the
position held by the employee at the time of his retirement. The pro-
visions of this section shall not apply to any employee who voluntarily
refuses to enter into any program approved by the County Council for a
retirement annuity which provides benefits for said employee.
Section 2. AND BE IT FURTHER ENACTED, that this Act, having
been passed by the County Council of Wicomico County at its Legislative
Session of October, 1968, shall take effect December 1, 1968, unless a
proper petition for referendum thereof shall be validly filed prior to said
date, in which event this Act shall not take effect until the expiration of
thirty (30) days following approval of this Act by a majority of the
qualified voters of the County voting in any such referendum.
