same as necessary to effectively fulfill the duties assigned to him. He
shall appoint, with the approval of the Governor, a Deputy Secretary
who shall have such duties as are provided by law or delegated by
the Secretary. The Deputy Secretary shall serve at the pleasure of
the Secretary and shall receive such compensation as is provided in
the State budget.

(d) The Secretary shall also appoint, with the approval of the
Governor, a General Counsel who shall be a member of the Maryland

Bar and who shall receive such compensation as is provided in the

State budget. The General Counsel shall serve at the pleasure of the

Secretary, and shall render legal advice and assistance to the Secre-

tary and to the Departments; Agencies; Commissions, Boards and
Councils included within the Department of Health and Mental
Hygiene. The General Counsel may not
represent the Secretary or

the Department of Health and Mental Hygiene or any of the com-

ponent agencies thereof in litigation except as otherwise provided
by law or authorized by the Attorney General. The General Counsel
may, with the approval of the Secretary, employ such Assistants as

are provided in the State Budget. All such assistants must be mem-
bers of the Maryland Bar. No
other department or agency within

the Department of Health and Mental Hygiene may employ legal

counsel except as authorized by law and approved by the Secretary.

(D) THE ATTORNEY GENERAL SHALL BE THE LEGAL
ADVISER TO THE DEPARTMENT. HE SHALL ASSIGN TO
THE DEPARTMENT SUCH NUMBER OF ASSISTANT ATTOR-
NEYS GENERAL AS ARE NOW AUTHORIZED BY LAW TO
BE ASSIGNED TO THE VARIOUS DEPARTMENTS, AGEN-
CIES, BOARDS, COMMISSIONS, COUNCILS, OR UNITS WHICH
ARE HEREIN, OR MAY HEREAFTER BY LAW BE DEEMED
TO BE PART OF THE DEPARTMENT OF HEALTH AND
MENTAL HYGIENE; AND HE SHALL ALSO ASSIGN TO THE
DEPARTMENT SUCH ADDITIONAL NUMBER OF ASSISTANT
ATTORNEYS GENERAL AS MAY HEREAFTER BE AUTHOR-
IZED BY LAW FOR SUCH DEPARTMENT. ONE OF THE SAID
ASSISTANT ATTORNEYS GENERAL SHALL BE DESIGNATED
BY THE ATTORNEY GENERAL AS COUNSEL TO THE DE-
PARTMENT OF HEALTH AND MENTAL HYGIENE. THE
COUNSEL TO THE DEPARTMENT SHALL HAVE NO DUTY
OTHER THAN TO RENDER, SUBJECT TO THE DISCRETION
AND CONTROL OF THE ATTORNEY GENERAL, SUCH LEGAL
AID, ADVICE AND COUNSEL AS THE SECRETARY AND THE
OTHER OFFICIALS OF SAID DEPARTMENT MAY REQUIRE,
AND THE SUPERVISION OF THE OTHER ASSISTANT AT-
TORNEYS GENERAL ASSIGNED TO THE DEPARTMENT.
AFTER THE ATTORNEY GENERAL HAS DESIGNATED AN
ASSISTANT ATTORNEY GENERAL TO SERVE AS COUNSEL
TO THE DEPARTMENT OF HEALTH AND MENTAL HY-
GIENE, HE SHALL NOT REASSIGN SAID COUNSEL WITH-<
