2106                              MUNICIPAL CHARTERS

confirmation by the Council; six-year programs, budget adoption
procedure and veto, and other provisions relating to fiscal affairs;
establishment by law of a merit system; adoption by law of a code
of ethics; certain general provisions, including continuity of govern-
ment in case of disaster; a procedure for amendment of the Charter;
and a schedule of transitional provisions delaying the effect of certain
sections and providing for the conduct of the government between the
effective date of the amended Charter, December 5, 1968, and the full
implementation of the amended Charter on December 7, 1970.

BE IT ENACTED BY THE COUNTY COUNCIL FOR MONTGOM-
ERY COUNTY, MARYLAND, that—

Section 1. The Charter of Montgomery County, Maryland is hereby
re-enacted, with amendments, to read as follows:

CHARTER

OF
MONTGOMERY COUNTY, MARYLAND

Preamble

We, the people of Montgomery County, Maryland, a body corporate
and politic, under the Constitution and general laws of the State of Mary-
land, do adopt this Charter as our instrument of government.

Article 1. Legislative Branch

Section 101. County Council

All legislative powers which may be exercised by Montgomery
County under the Constitution and laws of Maryland, including all law
making powers heretofore exercised by the General Assembly of Mary-
land but transferred to the people of the County by virtue of the adoption
of this Charter, and the legislative powers vested in the County Commis-
sioners as a District Council for the Montgomery County Suburban Dis-
trict, shall be vested in the County Council. The legislative power shall
also include, but shall not be limited to, the power to enact public local
laws for the County and repeal or amend local laws for the County hereto-
fore enacted by the General Assembly upon the matters covered by Article
25A, Annotated Code of Maryland, 1957, as now in force or hereafter
amended, and the power to legislate for the peace, good government,
health, safety or welfare of the County. Nothing herein contained shall be
construed to authorize or empower the County Council to enact laws or
regulations for any incorporated town, village or municipality in said
County on any matter covered by the powers granted to said town, village
or municipality by the act incorporating it or any subsequent act or acts
amendatory thereto.

Section 102. Composition and Election

The Council shall be composed of seven members, each of whom shall
be a qualified voter of Montgomery County. Council members shall be
nominated and elected by the qualified voters of the entire County. Each
of five members of the Council shall, at the time of his election, reside in a
different one of the five Councilmanic districts of the County. No member
of the Council shall hold any other office of profit in state, county or
municipal government. No member of the Council shall be eligible for
appointment during his term of office to any other office or position carry-
ing compensation created by or under this Char
